LP 가스 안전제고를 위한 법제화 방안 연구

The purpose of this study is to revise laws and regulations related to gas safety management that can directly affect people's bodies and health. Accidents continue to occur due to the unique nature of gas, and the rate of accidents due to insufficiency of facilities is high, as major matters in gas use such as safety inspection and inspection are regulated as autonomous. The continuous occurrence of gas accidents can be seen as a number showing the limitations of the current system. Therefore, in this study, a legal analysis and improvement plan for the improvement of the LPG safety management system, focusing on the supplier's obligations, were presented. To this end, in this study, similar laws and foreign countries regulations were reviewed, and the opinions of stakeholders were reviewed to revise the laws with high practicality. As a result, in this study, two revisions (proposals) were proposed. The first, 'Proposal to define the supplier's duty as the work of the counter-safety check', is a way to completely separate supply and safety check, and the supplier's duty such as safety check should be separated from the supplier and defined as the work of the safety inspection agent. The second plan, 'The duty of the supplier is to make the duties of the gas supplier, but entrust it to a safety inspection agent' is a reference to the Japanese security agency system. It is a plan to ensure that the supplier's obligations are more substantial than the present by requiring them to register with. In the revision (draft) presented in this study, it is important to find a way to activate the safety management agency above all else. Therefore, in this study, for efficient and professional operation of safety management tasks, ① regular safety inspection of the consumer’s facilities (safety inspection before supply is conducted by the supplier), ② management and action for nonconforming facilities as a result of inspection, ③ harm to the consumer The duties of the safety management agency were set up into five categories: guidance on matters necessary to prevent accidents, ④ distribution of promotional materials for the safety of gas-using facilities, and ⑤ emergency response (emergency dispatch/emergency contact). In addition, as a means of procurement of the financial resources, ① withholding tax from the importer is preferentially for securing financial resources, and the agency’s cost is set and settled according to the safety inspection performance; ② The safety management charge is settled according to the agency’s safety inspection performance; ③ Since it is for a private contract between the supplier and the agent or for the safety management of gas facilities, the budget of the state or local government is supported and the settlement method is proposed according to the agent's safety inspection performance.
