국제법상 복수 행위자의 공동책임에 대한 검토: ‘책임 공유(Shared responsibility)에 관한 원칙’을 중심으로

오늘날 국제사회에 ‘협력’과 ‘안보’는 중요한 키워드가 되고 있다. 국가들은 협력을 통해 우호적인 관계를 견고히 하고 집단적 조치를 그 어느 때보다 중요하게 여기고 있다. 20세기 이후 비국가 행위자가 국제사회에 중요한 영향력을 미치게 되면서 국가뿐 아니라 국제기구, 개인 등 다양한 행위자 간 상호작용을 통해 국제사회 질서는 급변하고 있다. 그에 따라 국제법상 둘 이상의 국가, 국제기구 및 그 밖에 비국가 행위자 등 복수 행위자가 관여된 행위로부터 발생하는 공동책임의 문제가 중요한 이슈로 대두되고 있다. 2001년 국가책임에 관한 ILC 초안 및 2011년 국제기구책임에 관한 ILC 초안은 현행 국제법상 책임제도에서 성공을 거둔 업적 중 하나로 평가되어왔고 학술적 권위가 있는 문건으로 인정받고 있으나 복수의 행위자가 관여된 국제공동위법행위를 둘러싸고 발생하는 공동책임 영역은 아직까지 법적 공백으로 남겨져 있다. 이와 관련하여 Nollkaemper는 국제법상 복수 행위자들의 국제위법행위로 책임이 발생하였을 때 복수의 행위자 관계에서 연유되는 책임으로 ‘책임 공유(shared responsibility)’ 개념을 도입하고 있다. 책임공유에 관한 논의는 2010년 이후 꾸준하게 진행되어 2020년 ‘국제법상 책임공유에 관한 원칙(Guiding Principles on Shared Responsibility in International Law)’ 초안이 작성되었다. 본고에서는 새롭게 도입된 책임공유의 개념을 바탕으로 책임공유에 관한 원칙을 검토하고 그 국제법상 의의 및 한계를 논하고자 한다.
Abstract
Nowadays ‘international cooperation’ and ‘global security’ have been the most important key word in international society. States try to remain strong allies through a series of different types of treaty and take collective measures. After the 20th centuries, due to emergence of non-state actors such as international organizations and NGO have performed significant role, the legal order of international society has changed dramatically. Due to this phenomenon, legal questions concerning international joint responsibility engaging multiple international actors have confronted serious problem in the international law of responsibility. Even though Draft Articles on the Responsibility of States for Internationally Wrongful Acts (2001) and Draft Articles on the Responsibility of International Organizations (2011) adopted by International Law Commission have become academic authoritative work in existing rules of the law of international responsibility, situations concerning joint responsibility from multiple international actors were hardly capture by these rules. Therefore Nollkaemper proposed “Shared Responsibility”, the new concept to deal with situations where a multiplicity of actors contributes to a single harmful outcome. This concept is not identical to particular form of responsibility exisiting in rules of law of international responsibility. Shared responsibility in International Law seek to provide important guidance when we confront legal questions concerning issues of joint responsibility from multiple international actors of internationally wrongful acts. Research project on shared responsibility in international law started in 2010, and drafting articles on principle of shared responsibility took place between 2016-2019 by Drafting Committee including Nollkaemper and other scholars. In 2020, Guiding Principles on Shared Responsibility in International Law has completed and these principles and commentaries have become an interpretative nature and progressive work building on the law of shared responsibility. The concept of shared responsibility can be applied in situations where multiple actors contribute to a single harm, such harm generally will be indivisible, in the sense that the proportion of harm attributable to each contributing actor cannot be determinded. Contents on definitions, concepts, and the mode of interpretation concerning shared responsibility is contained in principles on shared responsibility completed by Nollkaemper. Even though this principle has limit in that it follows the general theories and rules commented by ILC, the concept of shared responsibility and principles on shared responsibility will flexibly provide important guide line concerning the field of international joint responsibility.
