산재보험법상 노무제공자의 ‘사용종속관계’에 따른 보험료 부담비율 검토 - 퀵서비스 종사자를 중심으로 -

산재보험법에서는 산재보험의 적용 대상을 확대하기 위해 꾸준히 노력하고 있다. 특히, 근로기준법상 근로자와 유사한 형태의 노무를 제공하면서도 산재보험 적용되어 있어산업재해의 위험에 노출되고 있는 자들을 특수형태근로종사자로 정의하여 산재보험의적용을 받을 수 있는 제도를 마련하기도 했다. 그러나, 위와 같은 시도는 여러가지 제약조건에 의해 실효성이 높지 않았다. 이에 2022년 개정 산재보험법에서는 노무제공자를통해 산재보험 적용 대상을 보다 넓히려 한다. 노무제공자에 포섭되는 직종에는 ‘퀵서비스 기사’도 포함된다. 퀵서비스 기사는 몇십년간 그 업무가 동일했지만 법적 지위는 계속해서 변경되었고, 그럼에도 불구하고 아직까지 산재보험에 적용을 받는 비율이 높지않다. 본고에서는 퀵서비스업의 구조 및 종사자들을 상세하게 살펴보고 종사자들의 간의관계를 우선적으로 파악하고자 한다. 이를 통하여 개정 산재보험법의 노무제공자로서의퀵서비스 기사는 기존 특수형태근로종사자로서의 퀵서비스 기사가 가지는 산재보험 문제를 해결할 수 있는지 살펴보고, 산재보험료 부담비율을 검토하려 한다. 특히, 산재보험료 부담에 대한 단서규정에서 확인할 수 있는 ‘사용종속관계의 정도’에 대해 퀵서비스기사의 노동환경을 가지고 살펴보고자 한다.
Abstract
The Industrial Accident Insurance Act is making steady efforts to expand the scope of industrial accident insurance coverage. In particular, under the Labor Standards Act, those who are exposed to the risk of industrial accidents because they are covered by industrial accident insurance while providing similar types of labor as workers were defined as special types of workers. However, the above attempt was not effective due to various constraints. Accordingly, the Industrial Accident Insurance Act revised in 2022 seeks to expand the scope of industrial accident insurance coverage through labor providers. Jobs included in labor providers include 'motorcycle dispatch drivers’. Motorcycle dispatch drivers have had the same work for decades, but their legal status has changed over and over again, and yet the rate of coverage for industrial accident insurance is not high. In this paper, the structure and workers of the motorcycle dispatch industry are examined in detail and the relationship between workers is first grasped. Through this, motorcycle dispatch drivers as labor providers under the revised Industrial Accident Insurance Act will examine whether they can solve the problem of industrial accident insurance as existing special types of workers and review the burden ratio of industrial accident insurance premiums. In particular, we would like to examine the “degree of subordinate labor relationship” that can be found in the proviso to the burden of industrial accident insurance premiums with the working environment of motorcycle dispatch drivers.
