건설 현장 산업재해 예방을 위한 안전관리 개선방안:법제도 및 관리 감독체계를 중심으로

This study aims to examine legal and organizational conditions of disaster prevention at construction sites in order to make a policy recommendation, Particularly this study focuses on fatal accidents and identifies the problems in relevant regulations, governmental function of oversee, and behavioral defects of employees in construction industry. While existing studies approach from a technical perspective and suggest alternatives from a safety engineering perspective, this study deals with the safety management system from a macro perspective, focusing on the legal system and the government’s management and supervision functions. Over the past three years, the government has attempted to solve the problem through extensive legal system reform and expansion of organizational personnel, but the level of industrial accidents at construction sites has not been improved. By examining in-depth problems of those policy directions, this study make recommendations as follows; First, this study analyzes the statistics of construction accidents, figuring out the most frequent accidents from small sites, fall types, and unskilled workers. It is recommended to focus resources on budget input, strengthen safety standards, and strengthen safety education. Second, in terms of the legal system, the major problems this study addressees are the overlapping regulations between the Ministry of Employment and Labor and the Ministry of Land, Infrastructure and Transport, and too much formality in regulations. Lastly, the industrial safety management organization has tended to expand without effectiveness. Rather than expanding the size of the organization, it is necessary to rationalize the function of supervision at construction sites and improve their expertise.
