제도적 소외와 노동의 힘: 학교 사례를 통해서 본 노동권 형성의 궤적과 동인
The Historical Trajectory of the Formation of Labor Rights in School Industrial Relations

지난 10-20년 동안 공공부문의 노조조직률은 전체 노동조합 조직률의 궤적을 주도해 왔다. 공공부문 가운데에서도 학교는 노동조합 조직률 측면에서 두드러진 성과를 보였다. 특히 학교 비정규직의 경우 설립 10년 만에 10만의 조합원을 조직하였고, 몇 년 전부터는 전국 수준의 교섭까지 진행하고 있다. 업종수준에서의 교섭 그리고 중층화된 교섭구조의 형성은 금속산업, 보건의료서비스업, 금융업 등 그동안 여러 업종에서 시도되었다. 그러나 실질적으로 진전된 사례는 많지 않다. 학교 비정규직의 경우 지난 10여 년 동안 학교수준에서 교육청수준, 교육청수준에서 중앙수준으로 교섭의 무게 중심을 높이면서 교섭구조를 진전시켜 왔던 드문 사례이다. 저임금 여성노동자이면서 비정규직이라는, 한국사회가 안고 있는 구조적인 노동문제를 고스란히 안고 있는 학교비정규직 노동자들이 연대를 구축하고 중층적인 교섭구조를 완성해가며 고용안정성, 임금 및 근로조건을 비롯한 노동의 권리들을 꾸준히 진전시켜 온 모습은 역설적으로 보인다. 본 연구에서는 학교 사례를 통해서 노동권 형성의 역사적 궤적과 동인, 그리고 성격을 정리한다. 학교에서 교원노사관계, 공무원노사관계, 교육공무직 노사관계로 이어지는 노사관계의 형성과 무게중심의 이동을 설명하고, 이 과정에서 제도적 소외, 제도적 사각지대 등의 개념을 활용하며 그 동인이 노동자의 노동제도로부터의 소외와 이를 극복하려는 노동의 힘에 있음을 강조한다. 그리고 이를 통해 노동권의 형성과 변화를 설명하고자 하였다. 그리고 이 과정을 라이트가 제시한 노동의 힘과 계급타협 모형에 적용하고, 여기에 내부노동시장과 법제도 형성을 둘러싼 시계추운동을 결합시켜서 살펴보고자 하였다.
Abstract
Recently, the unionization rate in the public sector leads the trajectory of the overall unionization rate. Among the public sectors, schools are showing remarkable results in terms of unionization rates. In particular, in the case of non-regular school workers, 100,000 union members were organized during last 10 years after union establishment, and a few years ago, it has been conducting national-level negotiations. Although the collective bargaining at the industry level and the formation of a layered bargaining structure have been attempted in various industries such as the metal industry, health care service industry, and financial industry, there are not many cases in success. Among them, non-regular school workers are a case in which the bargaining structure has been advanced over the past decades. It seems paradoxical that non-regular school workers, who are low-wage female workers and have unstable employment, have steadily advanced their labor rights, including employment stability, wages and working conditions, by building solidarity and completing a multi-layered bargaining structure. We analyze the historical trajectory, drivers, and characteristics of labor rights through school cases. And We summarize that the drivers are in the exclusion from the institutions and the strength of the working class. In this process, we tried to increase explanatory power by supplementing the class compromise model proposed by Wright.
