학원스포츠산업의 법적 환경 개선을 통한 안정성 확보 방안

이 연구는 체육교육 현장의 실제적 일익을 담당하는 학원스포츠의 순기능과 역기능을 살펴보고 제도적 대안을 모색하는 데 그 목적이 있다. 연구목적을달성하기 위해 문헌고찰, 사례연구방법을 연구방법으로 실시하였다. 학원스포츠 관련 체육시설법, 설립운영법, 학원법 등의 법률과 선행연구를 검토 하였으며, 사례연구방법을 통해 학원스포츠 아카데미 운영 및지도자 5인을 대상으로 선정하여 2021년 4월부터 6월까지 심층 인터뷰를 실시하여 학원스포츠 현장의 문제점에 대하여 살펴보았다. 도출된 결론은 다음과 같다. 첫째, 학원스포츠현장에서의 문제는‘자격을 취득한 전문 체육지도자의 부재’,‘체육교습업 종목선정에 대한 명확성 부재’,‘체육교습업 부가가치세면세 적용의 한계성’,‘체육교습업 전면시행과 안전조치 사항 적용의 제한성’이었다. 둘째, 학원스포츠현장에서의 문제점을 해소하기 위한 대응전략은 제시되지 못하고 있으며 종사자들 간의 정보혼란으로불편이 가중되고 있었다. 셋째, 학원스포츠현장을 개선하기 위한 대안은 체육교습업 강사(지도자)의 자격기준 검증과 실제 청소년 대상 체육교습업 종목에대한 검토 및 재편성이다. 또한 체육교습업 부가가치세 면세 적용의 실질성을 검토와 관련 법 개정 요구로 나타났다. 또한 체육교습업 신고 절차에 대한 간소화와 명확한 기준을 정리할 필요가 있는 것으로나타났다.
Abstract
The purpose of this study is to examine the role function of academy sports and to find institutional alternatives. In order to achieve the research purpose, literature review and case study methods were conducted as research methods. Laws and prior studies such as the Academy Sports-related Sports Facilities Act, the Establishment Operation Act, and the Academy Act were reviewed, and in-depth interviews were conducted from April to June 2021 to examine the problems of the academy sports field. The conclusions drawn are as follows. First, the problems in the academy sports field were "absence of qualified professional sports leaders," "lack of clarity on the selection of sports teaching events," "limitations on the application of VAT exemption for sports teaching," and "restrictions on the full implementation of sports teaching and safety measures." Second, no response strategy has been proposed to solve problems in the academy sports field, and inconvenience has been increasing due to information confusion among workers Third, the alternative to improving the academy sports field is to verify the qualification standards of instructors (leaders) in the physical education industry and to review and reorganize actual sports teaching events for teenagers. In addition, it was found that the practicality of applying VAT exemption in the sports teaching industry was reviewed and related laws were revised.
