간호사의 의료행위에 대한 법적 고찰 — 간호법 제정을 중심으로 —

초록
우리나라는 의료인력의 부족, 환자 쏠림 현상과 같은 사회적 변화와 코로나 19 등 신종전염병 등의 발생으로 인한 높은 수준의 의료서비스에 대한 기대가 더욱 증가되고 있다. 과학기술의 발전과 경제 수준의 향상, 인구 사회학적 구조와 질병 양상의 변화, 건강관리 방법의 다양성 등이 그 원인으로 작용한다. 또한 고령화 사회로 진입하여 의료 및 간호 서비스의 수요가 급격히 증가하고 있다. 간호법안은 간호 인력과 관련하여 독립된 법률을 제정하여 간호 업무를 명확히 하고, 간호 인력의 체계적인 수급이나 교육을 통하여 간호 서비스의 질을 향상하고자 하는 것을 목적으로 한다. 현행 의료법은 국민의료에 필요한 사항을 규정함으로써 국민의 건강을 보호하고 증진하는데 목적하고 있지만, 급격히 변화하는 시대를 반영하고 의료인을 통합적으로 관리하고 감독 할 수 없는 한계가 있기 때문에 간호법 제정이 절실히 요구된다. 간호법 제정은 의료계의 합의를 기반으로 전문 인력으로서 간호사의 업무에 대한 사회적 현실을 반영하여 의료공백의 문제를 개선하고 국민의 생명과 건강에 기여할 것이다. 또한 부족한 의사 수, 의료 쏠림 현상으로 인한 실제 의료현장에서 관행적인 적법하지 않은 무면허 의료행위가 사라지기 위해서는 간호 인력을 재정비하는데 바탕이 될 것이다. 따라서 의료현실을 고려하여 국민의 건강과 안전 증진을 위하여 국가적 차원에서 긍정적 검토를 해주어야 할 것이다.
Abstract
In Korea, expectations for high quality healthcare services are increasing due to social changes such as the shortage of medical personnel, the phenomenon of patient overcrowding, and the outbreak of new infectious diseases such as COVID-19. This is due to advances in science and technology, improvements in economic levels, changes in demographic structure and disease patterns, and diversity in healthcare methods. In addition, the demand for medical and nursing services is increasing rapidly as we enter an aging society. The Nursing Act aims to clarify nursing tasks by enacting an independent law on nursing personnel, and to improve the quality of nursing services through the systematic supply and training of nursing personnel. The current Medical Act aims to protect and promote the health of the people by stipulating the necessary matters for national healthcare, but it has limitations that reflect the rapidly changing times and cannot integrally manage and supervise medical personnel, so the enactment of a nursing law is urgently needed. The enactment of the Nursing Act will improve the problem of medical gaps and contribute to the life and health of the people by reflecting the social reality of the work of nurses as professional personnel based on the consensus of the medical community. It will also be the basis for reorganizing the nursing workforce in order to eliminate illegal and unlicensed medical practice in the actual medical field due to the insufficient number of doctors and the medical concentration phenomenon. Therefore, it should be positively reviewed at the national level to promote the health and safety of the people in consideration of the medical reality.
