중국 국가데이터국 신설 의의와 시사점

초록
데이터가 적재적소로 흘러갈 수 있도록 하는 것이 4차 산업혁명 시대의 국가 경쟁력 확보의 필수조건이다. 이에 중국은 성(省)·시(市)급 지방 빅데이터 관리국을 신설하여 중앙↔지방정부 및 지방↔지방정부 간의 데이터 흐름의 개선을 기대하였으나, 소관부처 간의 담당업무 충돌·공백과 행정구역상 분절·파편화된 흐름은 소기의 성과를 내지 못하였고, 개선의 필요성이 제기되었다. 2023년 3월 7일, 14기 전국인민대표대회는 ‘국무원 기구 개편안’을 통과시킴으로써 데이터 기반 제도 수립을 책임지고, 데이터 자원의 공유·개발·이용을 총괄하는 국가데이터국(国家数据局)의 신설을 공식화함에 따라 중국 데이터 거버넌스에 중추 역할을 담당할 국가데이터국에 대한 기대와 함께 ‘빅 브라더’가 되지 않을까하는 우려의 목소리도 나오고 있다. 우리나라도 2020년 국가 데이터 컨트롤 타워의 필요성 제기되었고, 데이터청과 같은 정부조직 신설이 검토되었다. 당시 범국가적 데이터 정책 수립, 공공·민간데이터 통합관리·연계·활용 활성화 등을 위한 조직 신설 가능성과 기능에 대한 논의가 이루어졌으나, 기존의 거버넌스 조정에 관한 현실적인 문제에 부딪혀 더 이상 진전되지 않았다. 데이터 경제 활성화를 위해 앞으로 중국 국가데이터국이 수립해 나아갈 실효성 있는 조치는 우리에게 시사하는 바가 적지 않을 것이다. 2022년 9월부터 시행중인 ‘대한민국 디지털 전략’을 추진함에 있어 데이터 관련 법제도의 미비점이 지적되었는데, 중국 국가데이터국이 수립·운영할 데이터 기본제도를 참고하여, 우리의 입법·정책에 있어서 보완책으로 활용할 수 있을 것이다. 데이터 전담조직에 강력한 추진 동력을 부여한다는 측면에서는 중국의 모델이 효과적일 것이나, 체제가 다른 우리나라가 그대로 도입할 수는 없는바, 이에 상응하는 조직 신설에 대한 고민과 투명성을 더해 보다 개선된 대안 마련에 나서야 할 것이다.
Abstract
The use of data is important in order to secure national competitiveness in the era of the 4th industrial revolution. China has tried to improve data flow by establishing big data bureaus in provincial governments. However, the flow was divided because the tasks in charge were conflicting between government departments and were also divided into administrative provinces. So it didn't work out, and then the need for improvement was raised. On March 7, 2023, the National People's Congress of China established the National Data Bureau which is responsible for establishing the data framework. It also oversees the sharing, development, and use of data resources. As such, the bureau will play an important role in China's data governance. However, there are also concerns that it will become a so-called ‘big brother’. In 2020, Korea also raised the need for a data control tower at the national level. It was necessary to establish a data policy and integrate public and private data management. Therefore, the establishment of a new government organization was reviewed. However, there was no progress due to difficulties in adjusting the existing governance. Korea has been promoting the “Korea Digital Strategy” since September 2022. In the process, it was pointed out that the data-related legislation was insufficient. By referring to the basic data framework is established by the bureau, it can be used for legislation and policies in Korea. The Chinese model is effective in that a dedicated organization has strong leadership. However, it is difficult to accept China's model, which has a different political system and ideology from Korea, as it is. Therefore, it is necessary to consider adjusting the current governance by referring to the model.
