WTO SPS협정상 제6.1조 ‘SPS특성’과 SPS조치와의 ‘적합’에 관한 연구
The “Adaptation” of SPS Measures and the “SPS Characteristics” of Article 6.1 of the WTO SPS Agreement : From the perspective of “Risk Assessment” of Article 5

WTO SPS협정은 모두 14개 조항으로 구성되어 있다. 그중에서도 제6조 지역화 및 제5조 위험평가는 WTO 특정무역현안을 통해 높은 비중으로 다뤄지는 조항이다. 이 논문은 제6조 지역화 조항 중에서도 제6.1조에 초점을 두고 있다. 특히 제6.1조상에서 규율하고 있는 위험평가에 관한 요소를 확인하고, 이에 기초하여 제6.1조와 제5조와의 연계성을 논의한다. 이러한 제6.1조와 제5조 간 관계는 제6.1조를 쟁점으로 하는 India-Agricultural Products 사건, US-Animals 사건, Russia-Pigs 사건, Costa Rica-Avocados 사건을 통해 확인한다. 특히 Costa Rica-Avocados 사건에서는 패널이 제6.1조상의 ‘적합’과 관련하여 제5.3조상의 ‘경제적인 요소’를 구성하는 세부 항목에 관한 수입국의 고려 여부를 검토하였다는 점에서, WTO 회원국 또한 ‘경제적인 요소’를 고려하여야 할 필요성이 대두되었다. 이에 이 논문은 WTO 분쟁사례 소개와 함께 제6.1조를 검토 시 제5조 위험평가와의 연계성을 확인하였던 WTO 분쟁해결기구의 판정을 확인하고, 판정상 변화를 검토한다. 특히 Costa Rica-Avocados 사건을 위주로 법적 쟁점을 다음과 같이 검토한다: i) 모호한 제소국 주장으로 인한 입증책임 문제와 과학증거 제시, ii) ‘패널설치요청서’상에서의 제소국 주장･근거 부재로 인한 WTO 판정상 영향, iii) ‘적합’과 ‘위험평가’ 간 연계성: ‘SPS특성’에 따른 수입국의 SPS조치의 변동성･계속성 고려, iv) 제6.1조 제2문의 ‘평가’와 제5.1조-제5.3조상의 ‘위험평가’ 간 연계성 고려, v) 제6.1조 지역화 조항상의 ‘위험평가’ 관련 관할당국의 중요성과 당면과제이다. 이를 토대로 대응전략 또한 제시한다. 이 논문은 지역화에 관한 WTO 분쟁사례 중에서도 최초로 식물에 관한 지역화 분쟁에 해당하는 Costa Rica-Avocados 사건을 국내에 소개하고, 지역화와 위험평가 간 연계성에 관한 구체적인 이해를 돕고 있으며, 향후 제5.3조상의 ‘경제적인 요소’에 관한 논의를 촉발한다는 점에서 유의미하다.
Abstract
The World Trade Organization (hereinafter, WTO) Agreement on the Application of Sanitary and Phytosanitary Measures (hereinafter, SPS Agreement) consists of total 14 articles. Among them, the Regionalization(Article 6) and Risk Assessment(Article 5) has been highly raised with the issues of WTO Specific Trade Concerns, by WTO members. This paper especially focuses on Article 6.1, then reviews the Risk Assessment factors of Article 5 within the text of Article 6.1, and analyzes the relationship between Article 6.1 and Article 5 of the SPS Agreement. For this purpose, it is significant to review those WTO Disputes focusing on the Article 6.1, such as the India-Agricultural Products Dispute, the US-Animals Dispute, the Russia-Pigs Dispute, and the Costa Rica-Avocados Dispute. Especially, the Costa Rica-Avocados Dispute highlights the importance of “economic factors” of Article 5.3 in relation to the “adaptation” of Article 6.1. This implies that WTO members shall take into account “economic factors” of Article 5.3 in the case of “adapting their SPS measures to SPS characteristics of the area” according to Article 6.1. From this point, this paper reviews on rulings of the WTO Dispute Settlement Body of the above-mentioned disputes, and provides the improvements thereof, with pointing out several legal issues especially focused on the Costa Rica-Avocados Dispute. This paper helps to widen on the understanding the relationship between Regionalization and Risk Assessment of the SPS Agreement, introduces the Costa Rica-Avocados Dispute, for the first time. This paper induces prospective discussions and considerations of “economic factors” under Article 5.3.
