On March 14, 2023, the Personal Information Protection Act introduced the right to request the transfer of personal information, enabling individuals to demand the transfer of their personal information to themselves or third parties from data controllers. The introduction of this right aims to enhance individuals' control over their personal information and facilitate the development of MyHealthway businesses and the activation of digital healthcare. It plays a crucial role in improving accessibility and transparency of individuals' medical data, fostering patient-centered healthcare management. This legal implementation supports medical innovation and individual health management, providing opportunities for qualitative improvement in healthcare services at a national level. It is a critical juncture that necessitates careful consideration of measures that ensure both personal data protection and the interoperability of medical data, while promoting medical innovation and enhancing healthcare services. This study aims to explore and propose legal measures for the implementation of the right to request the transfer of personal information in the healthcare sector, striving for a balance between privacy protection and medical innovation, thus contributing to a balanced approach.
