최근(2021-2022) 일본 행정법판례의 동향과 검토

초록
본고는 2021년 하반기부터 2022년 하반기까지 일본 행정법에서 중요하다고 언급되는 판결들을 중심으로 살펴보았다. 크게 나누어 볼 때, 행정입법, 행정행위, 행정계약, 행정지도, 정보공개‧개인정보보호, 당사자소송, 국가배상과 관련한 판결들이다. 본고를 통해 국민들과 국가 간의 행정법과 관련한 문제는 어느 국가든지사회의 다양한 영역에서 생활의 필수적인 부분과 관련하여 상시 발생하고 있다는 점을 알 수 있다. 예컨대, 코로나19와 관련한 국민들과 국가의 법적인문제는 여전히 상존하고 있으며, 동일본대지진으로 인한 문제 역시 쟁점에대해서는 차이가 있을 수 있겠지만, 국내외에서 논의되고 있는 사안이다. 또한, 국가에 대한 정보공개의 청구와 관련한 문제 역시 법적인 해석과 적용에있어서의 중요성을 가지고 있다. 이외에도 본고에서 살펴본 바와 같이 국가가 생활수준에 따라 국민들에게 지급하는 생활부조비의 지급 등 국민의 생활에 있어서의 필수적인 부분과관련한 내용, 재외국민에게 최고재판소 재판관에 대한 심사권의 행사를 전혀인정하지 않는 것에 대한 문제를 볼 때, 우리나라에서도 국민들의 생활, 재외국민에 대한 권리보장에 대한 문제를 살펴봄에 있어 외국의 입법례로서 시사점이 있다. 뿐만 아니라 우리사회에서도 ‘갑질’ 등과 같은 직장내 괴롭힘과 관련한 문제가 대두되고 있는데, 일본에서도 특히 공무원 사회에서 이러한 문제가 발생한 것과 관련하여 2개의 중요판결이 언급되고 있는 점을 보면, 한국과 일본에서의 유사한 사회문제 역시 향후 함께 참고하며 풀어가야 할 과제로 생각된다. 또한 우리나라에서도 최근 아동학대에 대한 사회적 관심 등이 더욱 높아지고 있다. 이와 관련하여 일본에서도 아동학대에 대한 논의를 살펴보고 있다는 점에서 향후 우리나라와 아동복지에 관한 행정에 있어서 참고할 사항이있다고 보여진다. 최근 K-팝을 포함하여 다양한 형태의 K-컬쳐가 세계적으로 확산되고 있는데, 일본에서의 예술단체에 대한 지원과 관련한 점은 향후 우리나라에서도 유사한 문제가 발생하였을 때, 어떠한 결론을 도출할 수있을지 관심이 생기는 부분이다. 향후 우리 사회에서 발생할 다양한 행정법 관련 문제를 해결하기 위한방안을 검토함에 있어 일본 판례의 논의가 참고자료가 되기를 희망한다.
Abstract
This paper shows from the second half of 2021 to the second half of 2022 focused on important Japanese administrative law cases. A total of 10 cases are examined, and in terms of content, they are related to administrative legislation, administrative actions, administrative contracts, administrative guidance, information disclosure and personal information protection law, party suits, and state compensation. Through this paper, it can be further realized that administrative problems between the people and the state are always occurring in relation to essential parts of life in various areas of society. For example, it is a global situation that the legal problems of the people and the country related to COVID-19, and the problems caused by the Great East Japan Earthquake may also differ on issues, but they are being discussed globally. In addition, issues related to claims for information disclosure to the state also have importance in legal interpretation and application. From the cases examined in this paper, it shows social importance as follows. Although there are differences in social situations between countries, in relation to the occurrence of such problems in the civil service society. In addition, social interest in child abuse has recently increased in Korea. In this regard, Japan is also looking at discussions on child abuse, it seems that there are matters to be referred to in the administration of child welfare with Korea in the future. Recently, various types of K-culture, including K-pop, have been spreading around the world, and support for art organizations in Japan is an area of interest in what conclusions can be drawn when similar problems arise in Korea in the future. It is hoped that discussions in Japanese cases will serve as a reference in reviewing ways to solve various problems that will arise in our society in relation to administrative law in the future.
