AI 기술의 발전으로 전 세계적으로 생성형 AI 서비스의 사용이 대중화되고있다. 이러한 기술의 적용은 일련의 법적 문제와 과제를 야기하고 있다. 본 논문은 중국 법률 환경에서 생성형 AI 서비스에 대한 포괄적인 이해를 제공하고향후 법적 규제 전망에 대한 효과적인 통찰력을 제공하는 것을 목표로 한다. 먼저, 본 논문에서는 생성형 AI 서비스의 정의를 살펴보고 중국 내 적용 현황을 분석하여 포괄적인 배경 이해를 제공한다. 다음 현재 중국의 법적 생태 환경을 살펴보고 현존하는 법 체계의 단점과 미흡 점을 논한다. 중국 정부는 새롭게 부상하는 이 분야를 보다 효과적으로 관리하기 위해 「생성형AI 서비스관리임시 조치 방안(관리 조치)」을 발표했다. 이 논문에서는 이 조치의 정의, 적용 범위, 생성된 콘텐츠에 대한 규정, 개인정보 보호 및 데이터 출처에 대한조항 등 내용을 해석하기로 한다. 해당 초안을 평가할 때, 초안의 장점과 혁신은 물론 단점과 가능한 개선 사항도 명확하게 파악고자 한다. 마지막으로 「관리 조치」을 평가하고 생성형 AI에 대한 법적 규제의 향후 추세를 예측하려고한다.
Abstract
With the advancement of AI technology, the use of generative AI services is becoming popular worldwide. The application of such technology has brought about a series of legal issues and challenges. The purpose of this paper is to provide a comprehensive understanding of generative AI services in the Chinese legal environment and to provide effective insight into the future legal regulatory outlook. First, this paper explores the definition of generative AI services and analyzes the current state of application in China to provide a comprehensive background understanding. Then, starting from the current legal environment in China, the deficiencies and shortcomings of the existing legal system are revealed. To manage this emerging field more effectively, the Chinese government has proposed Provisional Measures for the Management of Generative Artificial Intelligence Services 『 Management Measures』. This paper provides an in-depth interpretation of the various provisions of the Measures, including their definitions, scope of application, regulations on generated content, and regulations on personal information protection and data sources. In the process of evaluating the approach, its merits and innovation are clearly pointed out, as well as the shortcomings and possible improvements. Finally, the approach is summarily evaluated and the future development trend of legal regulation of generative AI is predicted.
