In order to improve the instructor system, to give the instructor the status of a teacher and to specify details related to appointment and status guarantee, Higher Education Act has been revised in Korea. According to this Higher Education Act, the legal status of an instructor is secured, their identityies are guaranteed, there’s a positive side to it in that the instructor’s problems were somewhat solved, compared to the previous Higher Education Act. However, there occur another different problems that attempt to reduce the instructor’s number due to administrative and financial burdens in the the universities and colleges because of the introduction of the instructor’s system. In this kind of situation, the contents of the current instructor system and related precedents were reviewed. Based on this, Legal and institutional improvement directions have been suggested for guarantee lecturer’s legal status and rights. The contents are as follows. First, I suggest the basic direction to be implemented by the current instructor system and specific legislative tasks. the main contents are retirement allowance, payment of weekly holiday allowance, wage payment on Labor Day, subscribe to workplace health insurance, etc. Second, In order to stabilize the employment and improve the treatment of university instructors, it is necessary to introduce welfare expenses, employment guarantee for three years, increase payment of wages during vacation, introduction of the lowest-grade lecture fee, and revise teaching hours. Third, To solve the problems of the current instructor’s system, the regulations related to instructors must be abolished in the Higher Education Act, special laws, independent laws, need to be enacted to improve the status and treatment of instructors.
