기업 내부조사를 위한 탐정제도 도입방안에 관한 고찰

Today, the issue of industrial security has become an important issue from the point of view of companies. However, even when a technology leak occurs, it is difficult to publicly disclose it to the outside world, considering the company’s image and credibility, and it is not easy to obtain support from the national investigative agency. Therefore, from a company’s point of view, in order to prevent such technology leaks in advance, as well as to prevent various illegal or unfair acts by employees that occur inside the company, various systems such as the compliance officer system and the installation of a security team are intended to be prepared. However, except for large companies, However, it is difficult to expect to secure professional manpower to manage and supervise with a permanent monitoring organization due to facilities and financial conditions. Considering this situation, if the detective system for internal investigation of a company is used, it is possible to prevent or detect problems inside the company at an early stage through professional personnel at a low cost without disclosing it to the outside world. It will be of great help to the sound operation of the company and the strengthening of external competitiveness while maintaining. In Korea, detective is recognized as a job and activities are allowed, but the detective system has not yet been legislated and is in the process of social consensus. Therefore, it is true that there is a limit to the development of a detective system in a specific field of expertise because of the situation in which informal and limited detective activities are being conducted. Therefore, in this paper, the detective system for corporate internal investigation in Korea is reviewed by examining the current status of corporate internal investigation system, detective system, and corporate internal investigation detective system utilization in countries other than the United States, Germany, and Japan where the detective system has developed. Raise the need for the introduction of the system. In addition, while recognizing the need to nurture professional detectives for corporate internal investigations by identifying the current status of detective use in corporate internal investigations in Korea, specific operational plans when introducing the corporate detective system, legal issues and improvement plans when using the detective system etc., points to be noted are presented in detail.
