군 인권교육의 문제점 및 개선방안에 관한 연구

The Republic of Korea is a divided country and also a truce country. For this reason, Article 39 of our Constitution stipulates that all citizens shall fulfill the duty of national defense as prescribed by law, and that no one shall be subjected to disadvantageous treatment due to the fulfillment of military service duty. However, issues related to human rights violations are not easily known to the outside world in the military due to the closed space and strict rules and hierarchical order compared to the general society. As a result, numerous cases of human rights violations in the military are constantly being revealed, and at the same time, the military human rights-related system is being improved. However, the question of whether such education on human rights in the military is being carried out well in reality and the appropriateness of textbooks and lecture materials for military human rights education are also subject to controversy. In the case of human rights education, 24.7% of soldiers responded that they had not completed human rights education within the past year, while 17.2% of female soldiers and 7.8% of officers (male soldiers) responded that they had not completed human rights education. In addition, it has been reported in the media that there is a distorted human rights awareness in the expressions and contents of the human rights education textbooks for the Armed Forces, and that this needs to be corrected. Accordingly, in this study, after examining the general contents of military human rights education, problems and improvement plans were presented. First of all, after examining laws and regulations that serve as the basis for military human rights education, matters to be improved were derived, and improvements in the curriculum of cadets and cadets were reviewed to change the human rights awareness of commanders and staff. The reason why we are discussing ways to improve the military human rights education system is to raise the awareness of human rights among soldiers. Human rights are not differently applied during wartime and peacetime, but are values that the military must protect in normal times. If this consciousness starts from the military command and reaches the lowest level soldiers, it is thought that the current acts of human rights violations in the military will almost disappear. If the education process can be improved by amending related laws through this change in human rights awareness, and if the military human rights education contents are improved so that these human rights awareness can effectively reach individual soldiers, the military's true purpose of existence, war deterrence and peacekeeping, will be achieved.
