국방 안전사고에 대한 사고조사절차의 합리화 방안

국방부는 지난 2020년에 국방안전사고 사망자 수를 2025년까지 50%로 감축하는 것을 목표로 ‘국방 안전 혁신 방안’을 마련하겠다고 한 바 있다. 현재 국방부가 마련한 혁신방안들이 제대로 기능하고 있는 것인지에 대해서는, 군 업무 특성상 기밀성 및 폐쇄성으로 인해 정확히 확인하기 어려운 점이 있다. 그러나 분명한 것은 국방안전훈령 제정이 ‘국방 안전 혁신 방안’ 의 일환으로 이루어졌다는 것이다. 그리하여 국방안전훈령은 ‘국방 안전 혁신 방안’를 실현하기 위한 수단으로 볼 수 있다. 그러나 앞서 언급한 바와 같이 일련의 사건으로 국방안전훈령이 그 역할을 제대로 실현하고 있지 못하고 있음을 확인할 수 있었다. 국방부가 목표로 하고 있는 국방안전사고 사망자 수를 줄이기 위해서는 국방안전훈령상의 안전사고 조사 및 대응에 관한 규정과 그 외 관련 지침들은 반드시 개선되어야 할 것이다. 왜냐하면 국방 안전사고는 우리사회내에서 발생한 안전사고와는 여러 가지 면에서 분명한 차이고 있고, 현행 국방안전훈령상의 규정만으로는 각 군에서 수행하고 있는 업무의 특수성이 반영되어 발생된 사고에 대한 적절한 대응이 어렵기 때문이다. 따라서 국방안전사고를 조사함에 있어 그러한 복잡성을 고려한 보완 입법이 필요하다. 그리고 그러한 보완 입법의 하나의 기준으로써 국방 안전사고의 다양성과 복잡성을 고려한 안전사고조사절차 방안을 제시하였다.
Abstract
In 2020, the Ministry of National Defense announced that it would come up with a “defense innovation plan” with the goal of reducing the number of deaths in defense safety accidents by 50% by 2025. It is difficult to accurately confirm whether the current innovation plans prepared by the Ministry of National Defense are functioning properly. However, what is clear is that the enactment of the National Defense Safety Order was made as part of the ‘Defense Safety Innovation Plan’. Therefore, the Defense Safety Order can be seen as a means to realize the ‘defense innovation plan’. However, as mentioned above, it was confirmed that the National Defense Safety Order was not playing its role properly. In order to reduce the number of deaths in defense safety accidents, which the Ministry of National Defense is targeting, the regulations on investigation and response to safety accidents in the Defense Safety Order and other related guidelines must be improved without fail. Because national defense safety accidents are clearly different from safety accidents that have occurred in our society in many ways. This is because it is difficult to respond appropriately to special accidents among the duties performed by each service only with the current provisions of the National Defense Safety Order. Therefore, when investigating defense safety accidents, supplementary legislation is needed considering the complexity. As one direction of such supplementary legislation, considering the diversity and complexity of national defense safety accidents, a safety accident investigation system was proposed to prevent, prepare for, respond to, and recover safety accidents in the future.
