AI(인공지능)와 민주주의의 공생을 위한 헌법적 고찰

초록
사회를 구성하는 시민들이 공통적으로 원하는 정치체제를 우리 헌법은 민주주의로 확인하고 있다. 또한 대의민주제를 그 근간으로 하여 민주주의 핵심원리가 구현되고 있다. 주권자와 대표자간의 국가의사결정과정에 대한 신뢰는 투명성과 같은 민주주의적 원칙을 통해 작동한다. 대표자선출과정에서부터 대표자의 활동에 대한 신뢰성 확보 및 그 통제에 이르기까지 민주적 장치 없이는 그 공정성을 담보할 수 있다. 국민에 의한 지속적인 감시와 통제, 참여와 책임추궁을 위하여, 국민이 이러한 역할을 하고 권리를 행사하기 위해서는 국가기관이 국민 앞에 투명하게 놓여있어야 한다. 정치적 의사형성에 대한 국민의 참여는 자유롭고 평등한 것이어야 하며, 따라서 정치과정은 개방되어 있어야 하고 열린 공간에서 대화와 토론이 이루어져야 한다. 민주주의에서의 정치과정은 투명한 상태에 있어야만 주권자인 국민은 대표자의 활동에 대해 감시와 비판을 할 수 있고, 국회에서의 의사결정이 공정하게 이루어지는 것을 담보할 수 있으며, 국민이 특정한 정치적 쟁점을 이해하고 그와 관련한 의견을 형성･발표할 수 있는 정보를 얻을 수 있다. 이러한 민주주의 가치는 모든 새로 유입되는 기술, 정책, 가치 등에 동등한 기준으로 적용된다. 인공지능과 같은 새로운 기술은 다양한 사회적 가치의 변화를 제시하고 있지만 그 과정 속에 민주주의적 가치가 배제되는 일은 결코 없을 것이다. 오히려 민주주의와의 조화를 통해 인공지능 산업은 더욱 성장하고 발전할 수 있으며, 사회 속에 뿌리를 내릴 있게 될 것이다. 투명성 원칙은 국가기관의 의사결정을 비롯한 공공정보의 공개, 국가에 대한 감시와 통제 그리고 참여의 확보와 통제장치의 제도화를 목적으로 하는바, 이는 민주주의와 불가분의 관련성을 맺고 있고, 인공지능 또한 이러한 투명성의 의무에서 결코 자유로울 수 없을 것으로 본다. 우리 사회를 형성하는 대화와 토론, 감시와 통제, 참여와 책임추궁을 제대로 할 수 있기 위해서는 충분하고 완전한 정보의 확보를 전제 조건으로 하며, 그 자체로 민주주의의 핵심 요건이라 할 수 있으므로 인공지능 또한 이러한 가치를 더욱 강화시킬 수 있을 때 우리 사회의 중추적 역할을 담당할 수 있으며, 이러한 가치를 무시하면 무시할 경우 은폐되고 사장될 것이다. 따라서 인공지능 의사결정의 결과 및 절차의 충분하고 완전한 공개와 이해가능성, 공개된 정보를 바탕으로 한 절차적인 참여의 가능성 그리고 책임관계의 명확성과 통제가 충족될 때 비로소 이 사회의 한 일원이 될 수 있는 셈이다. 이렇듯 투명성과 같은 민주주의 원칙은 인공지능에 있어서도 규범적으로 합리적 활용가능성을 인정받기 위한 전제로 작동하며, 모든 새로운 과학기술과 마찬가지로 인공지능 산업 활성화 또한 이러한 민주주의적 가치를 실현시키는데 기여할 수 있어야 한다.
Abstract
Our Constitution confirms democracy as the political system that the citizens who make up society commonly want. In addition, the core principle of democracy is being realized with representative democracy as its foundation. Trust in the national decision-making process between sovereigns and representatives operates through democratic principles such as transparency. From the process of electing a representative to securing and controlling the reliability of the representative's activities, the fairness can be guaranteed without a democratic device. For continuous surveillance and control, participation and accountability by the people, in order for the people to play these roles and exercise their rights, state institutions must be placed transparently in front of the people. People's participation in forming political opinions must be free and equal, so the political process must be open and dialogue and discussion must take place in an open space. The political process in a democracy must be in a transparent state so that the people, who are sovereign, can monitor and criticize the activities of their representatives, ensure that decisions are made fairly in the National Assembly, and ensure that the people understand and understand specific political issues. You can obtain information to form and present opinions related to it. These democratic values apply equally to all new technologies, policies, and values. New technologies such as artificial intelligence are presenting changes in various social values, but democratic values will never be excluded in the process. Rather, through harmony with democracy, the AI industry can grow and develop further, and it will be able to take root in society. The purpose of the transparency principle is to disclose public information, including decision-making by state institutions, to monitor and control the state, to secure participation, and to institutionalize control devices, which are inseparably related to democracy, and artificial intelligence is also It seems that we will never be free from the obligation of transparency. Securing sufficient and complete information is a prerequisite for the dialogue and discussion, monitoring and control, participation and accountability that shape our society, which in itself is a key requirement for democracy. When values can be further strengthened, they can play a pivotal role in our society, and if these values are ignored, they will be hidden and abandoned. Therefore, it is possible to become a member of this society only when sufficient and complete disclosure and comprehensibility of AI decision-making results and procedures, the possibility of procedural participation based on open information, and clarity and control of responsibilities are met. It means there is. Likewise, democratic principles such as transparency operate as a premise for recognizing the possibility of normatively reasonable applicability in artificial intelligence, and like all new science and technology, the vitalization of the artificial intelligence industry should contribute to realizing these democratic values.
