The role of the state is crucial in ensuring a safe society in the modern risk society where various disasters are occurring frequently. In order to effectively carry this out, it is necessary to accurately grasp the current status of the legal and administrative response system for disaster and safety management and to complement and improve any shortcomings. First of all, regarding the legal response system, there is a need for systematic improvement and coordination among various related statutes that regulate matters related to disaster and safety management, with a focus on the 「Framework Act on the Management of Disasters and Safety」. In addition, it is necessary to review the formation of a dual legal system by dividing the current 「Framework Act on the Management of Disasters and Safety」 into separate laws for disaster legislation and safety legislation. In order to respond more appropriately to the changing disaster environment, it is necessary to promote policies that establish and strengthen a proactive disaster prevention system. Next, concerning the administrative response system, there is a need to strengthen the cooperation system between the central government and local authorities and enhance the disaster response system of local authorities responsible for the practical operation of disaster management. In addition, it is necessary to make up for the lack of the current support system for the recovery of disaster damage and to make it more realistic, so a review of institutionalizing the rights to disaster support is requested. It is also necessary to consider the introduction of a proactive advance payment system for compensation as an interim measure. If public administrations, including the government and local authorities, fully accept their responsibilities for efficient and effective disaster and safety management, and carry them out appropriately through the development of legal and administrative response systems, it will be possible to adequately reduce the loss of human life and economic damage caused by complex and diverse risks in modern society.
