일본 고령자 주택법제의 의의와 법적 정당성에 관한 고찰

인간생활의 터전으로서의 주택은 개인 및 가족 등이 건강하고 인간적인 생활을 함에있어 가장 기본적인 요소라는 점은 주지하는 바이다. 하지만 적절한 주거생활을 영위하기 위한 주택을 확보한다는 것은 사회적ㆍ경제적 제반 여건으로 인하여 각 개인의 자유경제적인 활동만으로는 부족한 경우가 많은 것이 사실이다. 나아가 일반적인 저소득자와는 달리 장애, 고령 등에 의한 주택문제는 또 다른 문제상황을 야기한다. 즉, 주택의 설비문제, 의료서비스 등이 필요하기 때문이다. 특히, 저출산ㆍ고령화라는 현대사회의 화두가 이야기하듯이 한국에서도 일본에서도 고령자에 대한 주택문제는 심각한 사회문제이다. 이에 본고는 우선, 일본의 주택정책의 기본법인 「주생활기본법」이 제시하는 일본 주택정책의 이념과 방향성이 무엇인지를 개관하고, 이러한 이념과 방향성을 실현하기 위한 조치사항은 구체적으로 무엇인지를 명확히 밝히고자 한다. 다음으로 「주생활기본법」 의 이념과 방향성을 고령자의 측면에서 구체화한 「고령자 거주안정 확보법」이 고령자의 거주안정을 확보하기 위하여 어떠한 법적 구조로 되어 있으며, 어떠한 정책 방식을 선택하고 있는지 살펴보고, 이 중 주된 방식으로 선택된 ‘민관협력’이 어떤 형태로 도입되어 있는지를 명확히 하여 고령자복지, 주거복지 등의 권리론적 측면에서의 정당성을 고찰하고자 한다. 이는 단순히 민관협력 방식의 유형을 고찰하고자 하는 것이 아니라 행정목적 달성을 위한 방법론에 내재하고 있는 법적 논점을 분석하기 위함임을 밝혀둔다. 본고에서는 상기 관점에 따라 일본 주택 정책의 이념과 방향성을 제시하고 있는 「주생활기본법」의 법적 구조와 특징을 분석한 후, 고령화 시대의 도래에 따른 고령자 주택지원 정책를 실시하기 위한 「고령자 거주안정 확보법」의 법적 구조와 특징을 분석함으로써 「고령자 거주안정 확보법」 제반 규정의 의의를 살펴보고자 한다.
Abstract
It is well known that housing as the basis of human life is the most basic factor for individuals and families to live a healthy and human life. However, it is true that securing a house to live an appropriate residential life often lacks the free economic activities of each individual depending on social and economic conditions. Furthermore, unlike ordinary low-income people, housing problems caused by disabilities and old age cause another problem situation. This is because housing facilities and medical services are needed. In particular, housing problems for the elderly are a serious social problem in both Korea and Japan, as the topic of modern society is low birth rate and aging population. First of all, I would like to outline the principles and directions of Japanese housing policy presented by the Basic Law on Housing Policy, and clarify specific measures to realize these principles and directions. Next, we will examine the legal structure of the Act on Securing Housing Stability for the Elderly, which embodies the philosophy and direction of the Basic Act on Housing Life, and how public-private cooperation is introduced. It should be clarified that this is not just to examine the type of public-private cooperation method, but to analyze legal issues inherent in the methodology for achieving administrative objectives. This paper analyzes the legal structure and characteristics of the Basic Law on Housing Life, which presents the philosophy and direction of Japan's housing policy.
