중국의 국토공간계획에 대한 법적 고찰

초록
중국은 개혁개방 이후 경제성장을 뒷받침하기 위한 국토개발정책을 시행하였고, 국토계획은 산업화, 도시화에 따른 토지공급을 중심으로 추진된 결과 국토공간의 무질서한 난개발과 환경오염, 지역경제의 불균형 등 문제가 사회적 쟁점으로 부각되면서 국토공간계획체계의 개편에 대한 논의가 시작되었다. 2014년 국토공간계획체계의 개편에 대한 논의가 시작되었으며, 2017년 1월에 성급 인민정부 국토공간계획 시범방안을 발표하여 시범사업을 추진하였다. 그후 2019년 5월과 10월에 중국 행정부인 국무원은 “국토공간계획체계 구축 및 감독실시에 관한 약간 의견”과 “국토공간계획에서 3개 통제선의 설정및 이행에 관한 지도의견”을 각각 발표하고 전국주체기능구계획, 토지이용계획, 도농계획, 해양공간계획, 도서보호계획 등 국토공간에 관련된 모든 계획을 국토공간계획의 틀내로 통합하여 국토공간 및 자원에 대한 체계적이고 효율적인 이용․개발과 보전을 시도하였다. 아울러 새로운 국토공간계획체계의 개편에 관한 내용을 법제화하기 위해 2019년에 「토지관리법」, 「도농계획법」, 「건축법」, 「도시부동산관리법」을 일부 개정하였으며, 자연자원부는 국토공간계획 및 공간관리 정책의 이행을 확보하기 위해 「국토공간계획법」 및 「국토공간개발보호법」의 입법을 추진 중에 있다. 본 연구는 중국 국토공간계획과 관련한 기존의 법령(laws and regulations)과 정책문서를 중점으로 국토공간관리정책의 변화과정과 국토공간계획의 전체적 체계와 유형, 주요 내용에 관한 기본적인 설명을 바탕으로 국토공간계획의 수립과 운영에 있어서의 중요한 쟁점들에 대해 살펴봄으로써 중국의 관련 법제도에 대한 이해를 돕고자 한다.
Abstract
After reform and opening up, China has implemented land development policy to support economic growth. The land supply was dominated by industrialization and urbanization. This development model has led to disorderly development, environmental pollution, and uneven regional development emerged, therefore, discussions on the reorganization of the spatial planning system have been begun. In 2014, discussions on the reorganization of the national spatial planning system have been started, and in January 2017, the Provincial People's Government announced the National Territorial Spatial Panning Pilot Plan and promoted the pilot project. Then, in May and October 2019, the State Council of China issued “Several Opinions of the Central Committee of the Communist Party of China and the State Council on Establishing a National Territorial Spatial Planning System and Supervising Its Implementation” and “Guiding Opinions on the Coordinated Delimitation and Implementation of Three Control Lines in National Territorial Spatial Planning”. All plans related to national territorial space, such as national subject functional zoning, land use planning, urban and rural planning, marine spatial planning, and island protection planning, are integrated within the framework of national territorial spatial planning to systematically and efficiently use, develop, and preserve national territorial space and resources. In addition, in order to legislate the contents of the new national territorial spatial planning system, the 「Land Management Act」, 「Urban and Agricultural Planning Act」, 「Building Act」, and 「Urban Real Estate Management Act」 were enacted in 2019. The Ministry of Natural Resources is in the process of enacting the National Territory Planning Act and the National Territory Development Protection Act to secure the implementation of national territorial spatial planning and space management policies. This study focuses on the existing laws and regulations and policy documents related to China's national territorial spatial planning, and based on the basic explanation of the process of the changes in national territorial spatial management policy and the overall system, type, and main contents of national territorial spatial planning, analyzes the main issues in the establishment and operation of national territorial spatial planning.
