공공기관 간 데이터 공유 및 공동 활용의 법적 쟁점 - 데이터기반행정법과 저작권법을 중심으로

국가의 정책은 모든 국민에게 적용되는 만큼 정책의 합리성은 국민의 권익 보호와 증진으로 이어진다. 이러한 의미에서 데이터에 기반하여 객관적이고 합리적으로 정책을 수립하고 의사결정에 활용하도록 하는 데이터 기반 행정의 당위성이 인정될 수 있다. 그러나 대상 데이터에 개인정보나 저작권 등 권리정보가 포함될 가능성이 높은 만큼 데이터 기반 행정의 가치와 권리자의 이익 간의 조율도 필수적으로 수반되어야 한다. 이에, 데이터 기반 행정에 관한 사항을 규율하고 있는 「데이터기반행정 활성화에 관한 법률」은 “데이터에 개인정보가 포함된 경우 해당 부분의 수집·제공 및 이용 등에 관하여는 「개인정보 보호법」에 따른다(제4조 제2항)”라고 규정하고 있으나, 저작권과의 관계는 규정하고 있지 않으며 관련 논의도 찾아보기 어렵다. 본 논문은 이러한 문제의식 하에 데이터 기반 행정에 수반되는 공공기관의 행위를 저작권법상 어떻게 해석할 것인지 분석하기 위하여 저작권법 제23조와 제35조의5를 검토하고 시사점 및 개선방안을 제시하고자 한다.
Abstract
As the national policy applies to all citizens, the rationality of the policy leads to the protection and promotion of the rights and interests of the people. In this respect, the justification for data-based administration to establish policies objectively and reasonably based on data and use them in decision-making can be recognized. However, as the target data is likely to include rights information such as personal information and copyright, coordination between the value of data-based administration and the interests of the right holder is essential. Accordingly, the Data-Based Administration Act stipulates that “if personal information is included in the data, the collection, provision, and use of the relevant part shall be governed by the Personal Information Protection Act (Article 4 (2)).” But the relationship with copyright is not stipulated, and it is difficult to find related discussions. With this awareness of the problem, this paper analyzes how to interpret the actions of public institutions involved in data-based administration under the Copyright Act, and reviews Articles 23 and 35-5 of the Copyright Act, and suggests implications and improvements.
