ESG 위험관리 관점 공급망 실사 및 컴플라이언스를 통한 무역 활성화 방안

Recently, ESG-related regulations have been strengthened from non-binding guidelines of international organizations such as the UN and OECD, which previously existed as soft norms, to national laws. In particular, in addition to export controls based on human rights issues directly related to trade, regulations on supply chain due diligence and related disclosures are expected to be applied offshore as an EU initiative. In response, the government is providing various support measures for supply chain due diligence, and companies are also responding through various methods, but there is a risk that efficient responses may not be made due to a lack of legal review and understanding. Therefore, a review based on legal understanding is necessary to prevent damage to Korean companies and revitalize trade. In this study, we reviewed ESG-related regulations that directly and indirectly affect trade, and related issues and systematic measures for supply chain due diligence and compliance from an ESG perspective. It also suggests ways to secure corporate autonomy, efficiency, and legal compliance in policy and legislative support for ESG supply chain due diligence and compliance, and examines the role of lawyers as legislative, administrative, and corporate experts.
