과거사청산 법제의 청산 인정기준에 관한 소고 -해방 이후 국가불법에 대한 포괄적 과거사청산을 중심으로

대한민국의 포괄적 과거사청산 법제는 기존의 개별적 과거사청산 법제와는 달리 국가 불법을 포괄적으로 규정하는 입법형식을 취하고 있어 청산의 인정기준이 상당 부분 해석에 의지할 수밖에 없는 것이 현실이다. 하지만 청산의 인정기준을 어떻게 볼 것인가에 대해 이해 관계인들, 특히 가해자 측과 피해자 측이 갈등과 분쟁을 일으킨다면 과거사청산의 실효성은 크게 반감될 수밖에 없다. 본 연구는 포괄적 과거사청산법률로 이해되는 「과거사정리법」, 「민주화보상법」, 「의문사진상규명에관한특별법」 등의 청산 인정기준 중 논란이 되고 있는 쟁점들을 검토해 본다. 특히, 「과거사정리법」의 민간인 집단희생사건, 인권침해사건, 적대세력에 의한 희생사건, 그리고 「민주화보상법」의 권위주의적 통치의 의미, 수배·기소유예·구금·강제징집·취업거부 등을 청산 대상에서 제외하여 발생하는 차별문제, 「의문사진상규명에관한특별법」에서 위법한 공권력의 간접적 행사의 의미 등이 주요한 검토의 대상이다. 그리고 논란이 되는 쟁점과 관련된 바람직한 해석의 방향과 대안을 제시함으로써 청산 인정기준의 객관성과 공정성을 높이고, 나아가 과거사청산을 원활하게 함으로써 민족의 정통성을 확립하고 국민을 통합하여 미래로 나아가는 동력으로 삼고자 하는 것이 이 글의 목적이다.
Abstract
South Korea has both individual and comprehensive past liquidation laws. However, since the Comprehensive Past Liquidation Act comprehensively defines national illegalities, the criteria for recognition of Liquidation are often left to interpretation. However, when the criteria for recognition are left to interpretation, tensions and conflicts arise between perpetrators and victims. In this case, the effectiveness of past liquidation is greatly reduced. This study examines controversial issues in the recognition criteria of comprehensive past liquidation laws. In particular, it focuses on cases of civilian mass victimisation, human rights violations, victimisation by hostile forces, the meaning of authoritarian rule, discrimination in relation to wanted, suspended, detained, conscripted or refused employment, and the indirect application of unlawful official power. It suggests preferred interpretations and alternatives. This work has the effect of enhancing the objectivity and fairness of the liquidation recognition criteria. In addition, by facilitating the liquidation of the past, it establishes national authenticity. And it unites the people to move forward into the future. This is the purpose of this study.
