개정「스토킹처벌법」분석과 실효적 대안에 관한 연구

2021년에 제정된 스토킹처벌법은 경범죄나 주거침입죄 등 상대적으로 가벼운 죄로 처벌되던 스토킹범죄를 예방하기 위해 시행되었으나, 스토킹범죄의 특성 및 피해자에 대한 인식이 부족으로 시행이후에도 여성들이 목숨을 잃는 사건도 발생하였으며, 법률의 미흡함으로 인하여 스토킹범죄를 근절에 어려움에 겪음에 따라 2023년 7월에 개정하게 되었다. 이번 법률개정에서 온라인 스토킹행위를 구체화 하였으며, 스토킹범죄 피해자에 대한 지원을 강화하였으며, 반의사불벌죄 조항을 삭제 하여 처벌을 강화하는 등의 변화를 가져왔다. 이러한 노력에도 불구하고 범죄피해자의 관점에서는 개선되어야 할 부분들에 대한 논의는 계속되어야 할 것임에 본 논문에서 여러 대안들을 제시하였다. 피해자 보호범위의 확장의 필요성을 비롯하여 피해자 보호명령제도, 미성년자를 대상으로 한 스토킹 범죄자에 대한 가중처벌의 필요성, 실효성 있는 접근 금지 조항 등에 대한 논의와 함께 경찰의 스토킹범죄 예방을 위한 정책적 대응방향을 제시하였다.
Abstract
The Stalking Punishment Act was enacted in 2021 to prevent stalking crimes, which were previously punished as relatively minor offenses such as misdemeanors and residential trespassing, but due to the lack of awareness of the nature of stalking crimes and victims, some women lost their lives even after the law was enacted, and the law was revised in July 2023 due to difficulties in eradicating stalking crimes due to inadequacies in the law. The revised law clarified the definition of online stalking, strengthened support for victims of stalking crimes, and strengthened punishment by deleting the provision of semi-impunity. In spite of these efforts, the debate on what needs to be improved from the perspective of crime victims should continue, and this paper proposes a number of alternatives. In addition to discussing the need to expand the scope of victim protection, the victim protection order system, the need for aggravated punishment for stalking offenders targeting minors, and effective restraining order provisions, this paper suggests policy responses to prevent police stalking crimes.
