상법 제814조의 인도한 날과 인도할 날의 기산일에 대한 법리적 해석에 관한 연구

상법 제814조에서는 운송인의 송하인 또는 수하인에 대한 채권 및 채무는 그 청구 원인의 여하에도 불구하고 운송인이 수하인에게 운송물을 인도한 날 또는 인도할 날로부터 1년 이내에 재판상 청구가 없으면 소멸한다. 다만, 이 기간은 당사자의 협상에 의하여 연장할 수 있다고 규정하였다. 본 연구는 대법원 판례를 분석하여 인도한 날과 인도할 날의 기산일을 항해용선계약의 항비부담, 지정장치장에 보관, 운송인이 지정한 영업용 보세창고에 보관, 화주가 지정한 영업용 보세창고에 보관, 화주의 보세창고에 보관, 운송인의 보세창고에 보관, 부두직통관화물, 화주와 터미널운영업자 간의 터미널사용계약, 복합운송계약, 운송인과 화주 간의 화물인수와 운송계약체결의 존재만을 인정하는 운송서류, Master B/L, House B/L, 화물선취보증서, 신용장거래, 운송화물의 멸실, 수하인의 운송화물 수령거부, 운송화물의 도난, 운송인의 운송화물 인도거부, 운송중단 등으로 구분하여 제시하였다. 이를 토대로 대법원과 부산고등법원의 판례를 분석할 결과 인도한 날의 기산일, 수하인에 대한 판단, 보세창고 업자간의 법률관계에 대한 법리적 해석의 문제점을 제시하였고, 운송인의 채권‧채무의 범위, 운송인의 채권‧채무의 발생시기, 운송주선인의 판단기준, 보험업자에게 주는 영향을 시사점으로 도출하였다.
Abstract
This study analyzed Supreme Court precedents and presented the date after delivery of the goods or the date when the goods should have been delivered as follows. First day, in a voyage charter contract in which the consignee bears the port costs, it is the day when the stevedorer receives the cargo at the terminal. Second, if transported cargo is stored in a designated storage area, it is the day the transported cargo is taken out of the designated storage area. Third, if transported cargo is stored in a commercial bonded warehouse designated by the carrier, transported cargo is stored in a commercial bonded warehouse designated by the shipper, in the case where transported cargo is brought into the carrier's bonded warehouse, in the case of cargo letter of guarantee it is the day the transported cargo is taken out of the commercial bonded warehouse.
