장애인용 자동차 감면의 조세심판례 분석을 통한 입법적 개선방안

초록
[연구목적]본 연구는 감면 이후 사후 추징에 따른 조세불복을 낮추는 방안을 연구하는 것을 목적으로 하고 장애인용 자동차 감면의 조세심판례를 분석하여 입법적 개선방안을 제시하는 것을 목표로 한다. [연구방법]지방세특례제한법 조문 중 대(代)개인 심판청구건수가 가장 많은 장애인용 자동차에 대한 감면의 청구인 주장을 분석하고 특성별로 정리하여 입법적 개선방안을 연구하였다. [연구결과]심판례의 청구 취지들을 검토한 결과 장애인을 위한 사유(특수학교 진학, 장애인용 임대주택 마련 등)가 세대분리 사유로 많은 부분을 차지한 것을 확인할 수 있다. 장애인에 관한 행정 규정들이 서로 충돌되어 세법개정의 측면에선 입법적 개선을, 관계부처 간의 행정적 협의 등 입법적, 행정적 개선이 동시에 필요한 것을 확인하였다. [연구의 시사점]심판청구의 청구인 주장을 통해 납세자에게 정확한 조세제도 이해하도록 하고 지속적으로 발생하는 문제들에 대해서는 보완이 필요함을 알 수 있다. 이를 통해 복지 관련 세제 혜택 등이 그 목적에 맞게 정상운영되는 데에 도움이 될 것을 기대한다.
Abstract
[Purpose]This study aims to analyze tax precedents related to tax reductions for cars for people with disabilities and then suggest legislative improvement. [Methodology]The provision with the highest number of individual judgment claims is the exemption for cars for the disabled. In this regard, the claimant’s claims were analyzed and organized by characteristics. [Findings]The results of reviewing the claims in the judgment are as follows. Reasons for the disabled (admission to special schools, provision of rental housing for the disabled, etc.) were often cited as reasons for generation separation. Administrative regulations regarding the disabled conflicted with each other, so legislative improvement was needed in terms of tax law revision. Legislative and administrative improvements, such as administrative consultation between relevant ministries, may be necessary at the same time. [Implications]Complementary points of related legislative regulations were presented as a way to help taxpayers understand the accurate tax system and reduce complaints and complaints accordingly. It is expected that this will help the system normalize.
