형사미성년자 연령을 둘러싼 증거기반(evidence-based) 연구의 검토와 전망

이 논문은 최근 정치사회적으로 큰 이슈가 되고 있는 소년범죄자의 형사처벌에 관심을 가지고, 국내 선행연구 및 언론보도 내용을 분석하여 주요 쟁점을 정리하였다. 그러나 국내 선행연구의 결과가 규범적 주장에 그치거나 근거로 제시된 경험적 증거가 오히려 논란이 되고 있다는 사실에 주목하여 최근 널리 받아들여지고 있는 ‘증거기반’ 개념을 재검토하고 증거기반 형사정책의 역사와 의미를 살펴보았다. 특히, 미국의 연구 사례를 바탕으로 형사미성년자에 대한 증거기반 연구를 소년의 책임능력 인정에 관한 뇌과학 분야의 증거, 그리고 소년사범의 형사이송 효과에 관한 증거를 체계적으로 검토하였다. 결론적으로 이 논문은 미국의 연구 사례가 현재 국내에서 벌어지고 있는 형사미성년자 연령 논쟁과 관련하여 직접적 증거가 되기 어려울 뿐 아니라 증거의 효과 역시 분명하지 않다는 점, 증거기반 연구에 내재한 탈맥락화와 방법론적 획일화 등 증거기반의 한계를 인식하는 것이 중요하다는 점을 지적하였다. 다만, 이러한 한계에도 불구하고 국내 형사정책 분야에서 증거기반 연구를 통한 타당한 지식의 축적과 이에 기반한 정책 수립은 계속해서 지향해야 할 것으로 전망하였다.
Abstract
This research focused on the issue of lowering the minimum age of criminal responsibility, which has been a hot political issue in South Korea. Reviewing domestic and foreign literature, we comprehensively examined the main grounds of each side. With this process, we found that debates have been too normative or have intensified the confusion through some evidence. To get through it, we covered the concept and the meaning of ‘evidence-based.’ Also, we reviewed American evidence-based research on the age of criminal responsibility from two aspects. First, we examined biological evidence such as brain maturation and neuroscience to see whether the juvenile offender is not indistinctive from adult offenders in doli capax. Second, we looked into empirical studies on juvenile transfer to determine whether reinforcing punishment for juvenile offenders brings about better outcomes like reducing recidivism rates. We carefully concluded that the negative impacts of lowering the minimum age of criminal responsibility would outweigh the positive impacts. Therefore, efforts to accumulate quality evidence are required with a prudent recognition that an evidence-based approach is not a panacea.
