초록
여성을 대상으로 한 폭행, 성범죄, 살인 등 강력범죄는 지켜보거나 따라다니거나 접근하는 행위로부터 시작하며, 이러한 모든 행위는 스토킹의 개념에 포섭된다. 따라서 스토킹 행위를 이해하기 위한 노력은 스토킹 행위 그 자체뿐 아니라 보다 심각한 강력범죄를 예방하기 위해서도 반드시 필요하다. 하지만 자기보고식 조사자료 및 판결문 등을 분석한 선행연구는 개별 사건의 상황적 맥락과 당사자들 간의 실제 상호작용을 살펴보는 데 한계가 있다. 본 연구는 선행연구의 공백을 보완하기 위하여 현장의 상황적 역학관계를 있는 그대로 보여주는 CCTV 영상을 분석 자료로 활용하였다. 유튜브에 공개된 스토킹 현장 CCTV 영상 30개 및 관련 기사 등을 활용하여 스토킹 행위자의 폭력사용 및 행위 중단 영향요인을 질적 분석한 결과는 다음과 같다. 첫째, 가해자 특성 요인, 공간적 특성 요인, 관계적 특성 요인이 가해자의 불완전한 상황판단을 통해 심각한 폭력으로 이어지는 인과관계 구조를 확인할 수 있었다. 둘째, 피해자의 언어적, 물리적 대응 방식 및 주변인의 개입이 스토킹 행위의 중단에 일정한 영향을 미친다는 사실을 확인할 수 있었다. 이상 분석 결과를 토대로, 효과적인 스토킹 관련 범죄 예방 대책 및 피해자의 방어 전략 등에 대하여 논의하였다.
Abstract
Violent crimes against women, including assault, sexual offenses, and homicide, often begin with the act of watching, following, or approaching, all of which are encompassed by the concept of stalking. Therefore, any efforts to understand stalking are essential not only to prevent stalking itself, but also to prevent more serious violent crimes. Nevertheless, previous studies analyzing self-reported surveys and court cases have limitations in examining the situational context of individual cases and the interactions between the parties. To fill this void, we analyzed CCTV footage that contains the situational dynamics of the stalking scenes. Using 30 CCTV videos of stalking scenes on YouTube and related newspaper articles, we qualitatively analyzed the factors that affected stalkers' use of violence and cessation of stalking. The findings can be summarized as follows. First, certain perpetrator characteristics, situational characteristics, and relational characteristics were associated with the use of violence through their effects on the perpetrator's decision-making. Second, the way victims or bystanders respond to stalking behaviors influenced the cessation of stalking behaviors. Based on these results, effective stalking-related crime prevention and victims' defense strategies were discussed.
