남북교류협력 거버넌스 분석: 법제도, 민간 행위자를 중심으로

This study examines the governance structure of inter-Korean exchange and cooperation in the post-Cold War era, with a particular emphasis on the role of private organizations. Inter-Korean relations, as per South Korean law, exist in a dual jurisdiction that simultaneously involves hostile exclusion and tacit recognition and cooperation. The governance of inter-Korean exchange and cooperation has seen an expansion and deepening of participation by various private organizations. Since the Framework Agreement between North and South Korea, both nations have experienced diverse developments in economic, socio-cultural, and humanitarian cooperation. Unique governance structures have evolved through ongoing cooperation between authorities and civil society. However, inter-Korean relations have encountered significant obstacles as escalating political and military crises and growing mistrust have overshadowed the continuity of exchanges, cooperation, and contacts in other areas. For future inter-Korean exchanges and cooperation to be sustainable in the long run, based on domestic political stability and legitimacy, it will be necessary to establish a governance structure that includes existing civilian organizations and systematically revise the basic legal framework for the coexistence and cooperation of the two Koreas.
