인공지능을 활용한 행정의 이론적 문제와 대응 - 체계이론의 관점에서 -

Today, as artificial intelligence technology develops rapidly, social interest in it increases. In line with this, artificial intelligence is used in various areas of society. Interest in artificial intelligence is also found in the administrative area carried out by the government. The government is making various preparations to utilize artificial intelligence in various administrative areas. The legal foundation necessary for this has already been established. However, not all problems related to using artificial intelligence in administration have been resolved. In relation to this, various legal theoretical, administrative law dogmatic, and administrative issues are raised. In this situation, this article examines what theoretical problems arise when using artificial intelligence in administration and then examines how to deal with them. However, on this topic, various prior studies have been conducted under the name of automation or automatic administration. As reviewing these studies, we can find that they raise quite persuasive problems and suggest solutions. For that reason, this article focuses on theoretical issues, especially legal and sociological issues, that have received relatively little attention in previous research. In particular, the author pays attention to theoretical critics raised from the perspective of human-centered administration. In addition, in order to respond to this problems, this article partly uses the perspective of systems theory established by German sociologist Niklas Luhmann. Based on this, this article argues how administration using artificial intelligence is possible.
