조소앙의 삼균주의와 헌법전문의 대한민국 임시정부 법통 계승의 의의

조소앙은 치열한 독립운동 과정에서 삼균주의를 정립했다. 삼균주의는 크게 혁명론과 삼균론으로 구분된다. 혁명론은 혁명적 수단으로 일본제국주의 침탈 세력을 박멸하고 국토와 주권을 완전히 광복하는 것을 목표로 하는 독립운동의 방법론이고, 삼균론은 국내적으로는 정치ㆍ경제ㆍ교육 영역에서 개인과 개인 사이의 균등(정치균권ㆍ경제균부ㆍ교육균학)을 실현하고, 국제적으로는 민족과 민족, 국가와 국가 사이의 균등을 실현하여 궁극적으로는 세계일가의 이상을 실현하는 것을 요지로 하는 경세론이다. 삼균주의의 사상적 배경으로는 대동사상, 대종교, 아나키즘, 사회주의, 대공주의, 삼민주의 등이 거론되는데 그 중 삼균주의는 대동사상과 대종교의 영향을 강하게 받았다. 삼균주의가 국가공동체의 가장 중요한 가치로 균등을 설정한 이유는 유교의 전통적인 대동사상을 서구사상 등과 접목해 평등사회 이상론을 펼친 강유위의 대동사상 영향을 직접적으로 받았기 때문이다. 국가공동체의 생활영역을 정치ㆍ경제ㆍ교육의 세 분야로 나눠 각 분야의 균등을 추구하게 된 것은 한얼님을 조화ㆍ교육ㆍ치화의 3대 권능을 두루 갖춘 삼신일체의 신으로 보는 대종교의 삼일신 교리의 영향일 가능성이 높다. 삼균주의는 배태기, 형성기, 정립기의 3단계를 거쳐 발전했는데 배태기의 모습은 「대한독립선언서」를 중심으로, 형성기의 모습은 한국독립당의 「당의」와 「당강」을 중심으로, 정립기의 모습은 「대한민국 건국강령」을 중심으로 각각 살펴본다. 삼균주의의 역사적 의의는 독립운동의 좌우 분열과 대립 상황에서 자본주의의 길도 사회주의의 길도 아닌 제3의 길을 제시함으로써 독립운동의 지도이념이 되었을 뿐 아니라 대한민국의 건국 정신으로까지 천명되었다는 점에서 찾을 수 있다. 우리 헌법은 전문에서 대한민국 임시정부의 법통 계승 규정을 두고 있는데 이 규정은 헌법적 효력을 지닌다고 보아야 한다. 따라서 대한민국 임시정부가 「대한민국 건국강령」을 통해 삼균주의를 대한민국의 건국 정신이라고 분명히 밝힌 이상 우리도 삼균주의를 대한민국의 건국 정신으로 인정하고 이를 이어받아야 헌법적 의무가 있다. 하지만 우리나라의 현실을 보면 비록 민주화와 산업화를 동시에 성취하는 빛나는 성과를 내기는 했으나 권력이 중앙 엘리트에 집중되는 중앙집권적인 정치 현실, 소득 불평등과 빈부격차가 날로 심화되는 경제 현실, 무한 경쟁과 입시지옥에 시달리는 핍진한 교육 현실에 비춰볼 때 삼균주의가 제대로 구현되었다고 보기는 어렵다. 따라서 이제라도 삼균주의가 제대로 구현되는 나라를 만들기 위한 노력이 절실히 필요한 때다. 그 노력은 헌법전문의 임정 법통 계승 규정을 근거로 삼균주의를 대한민국의 건국 정신으로 천명하는 것에서부터 시작될 수 있다.
Abstract
In the course of the independence movement, Cho So Ang formulated Samkyunism(the Principle of Three Equalities). Samkyunism is broadly divided into revolutionary theory and Samkyun theory. Revolutionary theory aims to eradicate the Japanese imperialist power through revolutionary means and fully restore the national territory and sovereignty. Samkyun theory aims to realize equality between individuals in the political, economic, and educational spheres (political equality, economic equality, and educational equality) domestically, and equality between peoples, nations, and countries internationally, ultimately realizing the ideal of a world family. The main ideological background of Samkyunism is the Ideal of the Great Hormony and Daejonggyo. Samkyunism developed through three stages: germination, formation, and establishment. The historical significance of Samgyunism can be found in the fact that it not only became the guiding ideology of the independence movement, but also the founding spirit of the Republic of Korea. In the preamble of our Constitution, inheritance of the cause of the provisional government of the Republic of Korea, which has constitutional effect. Therefore, since the Provisional Government of the Republic of Korea has clearly stated that Samkyunism is the founding spirit of the Republic of Korea, we have a constitutional obligation to recognize Samkyunism as the founding spirit of the Republic of Korea and inherit it. It is now urgently necessary to make efforts to distribute power and wealth evenly among the people based on Samkyunism. The effort can begin by declaring Samkyunism as the founding spirit of the Republic of Korea.
