해양동물 보호 관련 국내 법제의 문제점 및 개선방안

해양은 인류의 생존과 밀접한 관련을 지닌 공간으로 육상보다 넓은 부분을 차지하고 있으나 해양 생태계와 생물종에 대해서는 육상의 그것보다 덜 중요하게 인식되어 왔다. 해양동물의 경우, 그동안 경제적 이용의 측면에서 ‘수산자원’으로 다루어졌을 뿐 그 보호대상으로의 가치 인식은 육상동물보다 뒤늦게 시작되었다고 할 수 있다. 여전히 해양동물의 보호는 ‘이용’과 ‘보호’를 어떻게 융합하고 조정할 것인가의 문제라고 할 수 있다. 특히 해양생태계법 등 해양동물 보호관련 법제와 수산관련 법제 간의 정합성 제고와 가시성 측면에서 차이를 보이는 육상에서의 야생동물 보호와 해양동물 보호의 차별적 접근방법에 대한 검토가 요구된다. 나아가 관할권 이원지역의 해양생물 보전 등 국제사회가 지향하고 있는 해양동물 보호 체계를 어떻게 국내법적으로 수용할 것인가, 기후위기로 인한 해양의 변화를 해양동물 보호의 관점에서 어떻게 고려하여야 할 것인가, 해양생태계 중심의 접근방법과 특정 해양동물의 보호를 위한 생물종 중심의 접근방법을 어떻게 하나로 융합하여 제도화 할 것인가에 대한 논의가 지속적으로 이루어져야 할 것이다. 본고에서는 해양동물의 보호에 있어서 육상동물과의 차이점과 이에 따라 환경부 소관 법률의 보호규정과 유사한 해양동물 보호체계의 변화 필요성을 제시하였다. 법정계획의 수립이나 지정체계에 있어 미흡한 부분의 보완이 요구되지만 해양동물의 보호조치나 관리체계는 육상에서의 멸종위기 야생동물의 보호나 관리체계와 구별될 필요가 있다. 이러한 측면에서 해양생태계법이 규정하고 있는 해양보호구역과 보호동물 지정체계의 개선, 행위제한 규정의 구체화, 보호구역에서 포획 등이 제한되는 해양생물의 지정 고시의 마련, 벌칙의 중복규정에 대한 법제 개선이 요구된다.
Abstract
The ocean is a space closely related to human survival and occupies a larger part than land, but marine ecosystems and species have been recognized as less important than that of land. In the case of marine animals, it has been treated as a “fisheries resource” in terms of economic use, but recognition of their value as a protected object began later than that of land animals. Still, the protection of marine animals can be said to be a matter of how to fuse and adjust ‘use’ and ‘protection’. In particular, it is necessary to consider a differential approach to wildlife protection on land and marine animal protection, which differs in terms of visibility and consistency between marine animal protection-related laws such as the Marine Ecosystem Act. Furthermore, discussions should continue on how to legally accept the international community's marine animal protection system, such as the preservation of marine life in the dual area of jurisdiction, how to consider changes in the ocean due to the climate crisis from the perspective of marine animal protection, and how to integrate and institutionalize a marine ecosystem approach and a species approach to protect specific marine animals. In this paper, the difference between land animals in the protection of marine animals and the need to change the marine animal protection system similar to the protection regulations under the Ministry of Environment was presented. Although insufficient parts of the legal plan or designation system are required to be supplemented, the protection or management system of marine animals needs to be distinguished from the protection or management system of endangered wildlife on land. In this regard, it is necessary to improve the designation system of marine protected areas and protected animals stipulated by the Marine Ecosystem Act, specify regulations on restrictions on behavior, prepare a notice on the designation of marine life that is restricted from capturing in protected areas, and improve legislation on overlapping regulations on penalties.
