건축물 및 시설물 건설공사의 안전성 제고를 위한 입법 체계의 정합성 확보 방안

초록
최근 공사중 건축물 붕괴사고가 또 발생했다. 발주자, 설계자, 시공자, 감리자 등 누구 하나의 책임이 아니라 총체적 부실로 발생한 것이다. 건설공사는 설계-시공-감리 등의 단계적 절차로 이루어진다. 관련 법률로는 「주택법」, 「건축법」, 「건설기술 진흥법」, 「건설산업기본법」 등이 있다. 그러나 현재 건축물․시설물의 건설공사 수행 체계는 건설공사 관련 기본법의 이념과 정책 방향에 따라 개별 법률에서 세부 내용을 규율하는 것이 아니라 개별 법률 자체적으로 필요와 이해관계에 의해서 각각 규율되고 있다. 결국 현재의 건설공사의 수행 체계 및 입법 체계는 정합성이 미흡한 상황이고, 이는 안전 사고로 이어질 개연성이 높다고 할 것이다. 따라서 건축물․시설물 건설공사의 안전성 제고를 위해서는 건설공사의 수행 체계 및 입법 체계에 대한 정합성 확보가 필요하다. 구체적으로는 「주택법」상 분리발주에 대한 재검토, 「건축법」상 건축사와 관계전문기술자와의 협력 의무 강화, 「건축법」상 설계-시공-감리의 수행체계와 「건설기술 진흥법」상 건설사업관리의 체계를 통합하는 방안 등을 논의할 필요가 있다. 이를 전제로 「건설산업기본법」과 개별법으로 체계화하여 건설공사의 이해와 예측 가능성을 제고할 필요가 있다.
Abstract
Recently, another building collapse occurred during construction. It was not the responsibility of anyone, including the project owner, designer, constructor, or supervisor, but was caused by total insolvency. Construction work is consists of step-by-step procedures such as design-construction-supervision. Related laws include the Housing Act, the Building Act, the Construction Technology Promotion Act, and the Framework Act on the Construction Industry. However, the current construction system of buildings and facilities does not regulate individual laws according to the ideology and policy direction of the basic law, but individual laws are regulated according to interests. In the end, the current construction work implementation system and legislative system are inconsistent and can lead to safety accidents. Therefore, in order to improve the safety of building and facility construction work, it is necessary to secure consistency in the implementation system and legislative system of construction work. Specifically, it is necessary to review the Design-bid-build under Housing Act, strengthen the Related Specialized Engineers under Building Act, and integrate the system of design-construction-supervision under the Building Act and the system of Management of construction project under the Construction Technology Promotion Act. On this premise, it is necessary to improve the understanding and predictability of construction work by systematizing it into the Framework Act on Construction Industry and individual laws.
