「발달장애인 권리보장 및 지원에 관한 법률」과 「장애인복지법」의 비교 및 개정 필요성에 대한 연구

본 연구는 장애인의 인간다운 사람과 권리보장을 위한 일반법인 「장애인복지법」에 따라 설치 및 운영되는 장애인권익옹호기관의 장애인학대 사례지원 절차와 발달장애인의 특성과 욕구를 반영하여 발달장애인에게 적합한 지원을 하기 위한 특별법인 「발달장애인 권리보장 및 지원에 관한 법률」에 따라 설치 및 운영되는 발달장애인지원센터의 권리구제지원 절차를 비교하여 그 유사성을 확인하고, 「발달장애인 권리보장 및 지원에 관한 법률」이 발달장애인을 위한 특별법으로서 기능하기 위해 같은 법과 「장애인복지법」에서 개정되어야 할 조항을 제시하며, 「장애인복지법」에서 규정하고 있는 범죄 신고인에 대한 불이익조치 금지 규정을 「발달장애인 권리보장 및 지원에 관한 법률」에도 도입하여 신고인이 발달장애인에 대한 유기등 범죄에 대한 신고로 인해 불이익조치를 당하지 않도록 규정할 필요가 있다는 점을 제시하기 위한 연구이다. 이에 따라 본 연구에서는 「발달장애인 권리보장 및 지원에 관한 법률」이 특별법으로 기능하기 위해 「장애인복지법」 상 설치 및 운영되는 장애인권익옹호기관의 지원대상에서 발달장애인을 제외하여 발달장애인에 대한 지원은 발달장애인지원센터를 통해 이루어지도록 할 필요가 있고, 직무상 발달장애인에 대한 유기등 사건을 인지한 수사기관은 장애인권익옹호기관이 아닌 발달장애인지원센터에 그 사실을 통보하도록 할 필요가 있으며, 발달장애인지원센터 또는 수사기관에 발달장애인에 대한 유기등 범죄를 신고한 신고인에게 불이익조치를 할 수 없도록 하는 규정을 신설하여 신고인을 보호할 필요성이 있다는 점을 서술하였다.
Abstract
This study compares the procedure for supporting abuse of the disabled by the disabled rights advocacy agency with the procedure for supporting rights relief of the developmental disability support center to confirm the similarity, in order for the Act on the Guarantee and Support of Rights of Persons with Developmental Disabilities to function as a special law for persons with developmental disabilities, support for persons with developmental disabilities shall be provided only through the Support Center for Persons with Developmental Disabilities, investigation agencies that investigate cases of abuse against people with developmental disabilities shall notify the support center for people with developmental disabilities, aimed at suggesting that it is necessary to prevent disadvantages from being taken to reporters who have reported abuse crimes against people with developmental disabilities.
