하나의 토지에 하나의 건축적 용도를 부여하고, 자동차를 중심으로 하는 교통시설을 중심으로 설계되어 있는 공간 법제는 강력한 도전에 직면하여 있다. 코로나로 인한 재택근무의 강제적 경험과 비대면 상업서비스의 활성화에 따라 새로운 모빌리티 기술이 상용화되기 이전 단계인 현시점에서도 이미 주거/상업 용도의 엄격한 구별은 붕괴하고 있다. 이 논문에서는 기술 변화 속에서 새롭게 등장하고 있는 모빌리티인 개인형 이동장치(personal mobility), 도시형 공중 모빌리티(urban air mobility), 자율주행자동차라는 세 가지 기술 수단을 중심으로 공간법제의 도전과 대응, 향후 과제를 살펴 보았다. 새로운 모빌리티의 등장은 현 단계에서는 자동차 도로를 중심으로 설계되어 있는 공간 법제의 부분적 조정을 요구하고 있다. 아직까지는 현행 제도 내에서 기존 모빌리티 체계 내에 새로운 모빌리티를 포섭시키고, 안전한 활용을 위한 제도적 배려 방안을 마련하는 것으로 대응할 수 있을 것으로 보인다. 그러나 향후 다가올 고도의 자율주행 자동차의 상용화와 UAM 대중화는 공간 법제의 근본적인 구조 변경을 동반하게 될 것이다. 그에 대비하여 제도 개편 방향의 설정을 위한 예측적 판단과 사회적 합의를 위한 토론도 필요한 시점에 이르렀다.
Abstract
The spatial legislation, which assigns one architectural use to one piece of land and is designed around transportation facilities centered on automobiles, is facing strong challenges. Due to the forced experience of working from home due to the coronavirus and the activation of non-face-to-face commercial services, the strict distinction between residential/commercial use is already collapsing even at this stage before new mobility technologies are commercialized. This study focuses on the challenges and responses to spatial legislation, and the future, focusing on three technological means of mobility that are newly emerging amid technological changes: personal mobility, urban air mobility, and autonomous vehicles. The emergence of new mobility requires partial adjustment of the spatial legislation, which is currently designed around automobile roads. So far, it appears that it will be possible to respond by incorporating new mobility within the existing mobility system within the current system and preparing institutional considerations for safe use. However, the upcoming commercialization of highly autonomous vehicles and the popularization of UAM will be accompanied by fundamental structural changes in spatial legislation. In preparation for this, we have reached a point where predictive judgment and discussion for social consensus are needed to set the direction of system reform.
