중국 환경법상 단체소송에 관한 고찰

China has achieved rapid economic growth, but the air pollution, water pollution, soil pollution, and the marine pollution have also become severe because of industrialization and urbanization. Since the late 1980s, environmental issues have become increasingly serious and urgently need to improve, therefore, many environmental groups have burgeoned. These environmental groups intervene in various forms to disclose the situation of environmental pollution and damage. They do not advocate infringement of personal rights, only emphasize the suitability of the plaintiff for infringement of the natural environment. With these unremitting efforts, the Environmental Protection Act was revised in April 2014, allowing some eligible groups to sue for actions when the environmental public interest was damaged. The environmental group litigation system under the Chinese Environmental Act can not only deal with the natural environmental damage caused by industrial and human activities, but also prevents the environmental pollution damage in the future. This paper objectively researches the cases of environmental group litigation to analyze the legal disputes and issues related to the contents of the group litigation system under the Chinese Environmental Act, and provides inspiration for introducing the environmental group litigation system in Korea.
