의료 마이데이터 활용의 법적 과제

As the three data laws (Credit Information Act, Personal Information Protection Act, and Information and Communications Network Act) are revised and implemented in 2020, ways to revitalize the data economy in each industry are being actively discussed. With the revision of these laws, the concept of pseudonymous information was introduced, making it possible to use information without the consent of the information subject for special purposes, which expanded the scope of big data use in various fields. In the field of medical information, the use of which was previously limited due to various regulations, the introduction of the ‘My Data’ concept and the possibility of new uses based on services are being discussed. Since medical information is sensitive information and is used in the private sector, there are many issues that need to be resolved in terms of safety, security, and social consensus. To solve this problem, the government promoted the ‘My Data Pilot Project’ in 2019-2020. Through this, a service system was established that allows individuals to manage patient information, treatment, prescription, and examination/examination information generated by various institutions and utilize it in emergency situations. Of course, the development of the medical mydata industry does not only have positive aspects. Rather, indiscriminate use of medical information can become a serious problem. In this regard, there is a need to legally review medical my data projects and the right to request transmission of personal information.
