젠더 관점에서 본 「스포츠기본법」 개정방안

The purpose of this study is to propose amendment of the 「Basic Law on Sport」 by examining and discovering problems in terms of gender perspectives. The 「Basic Law on Sport」 is the only sport representative law that can comprehensively and systematically regulate the field of work while overseeing the sport field. Since it can be considered to be in a superior position compared to ordinary legal regulation, the presence of this law itself is considerable. The legal nature of the 「Basic Law on Sport」 can be seen as closer to the nature of the ‘Basic Law on Sport Policy’, which is the basis of sport policy as a whole, rather than the ‘form of charter’ that conveys the basic ideology. Therefore, since sport policies are established based on the「Basic Law on Sport」, the ripple effects of this law should be fully considered. Considering this influence, this study examined the 「Basic Law on Sport」 from a gender perspectives. Over the past few decades, we have witnessed gender issues in sport, and we have fought fiercely to eliminate them. However, gender issues such as imbalance of gender ratio between athletes and coaches, inequality in employment and labor of female players/coaches, and career interruption due to childbirth and childcare of female players/coaches remain unresolved. Now that the 「Basic Law on Sport」 has been enacted, we hope that the law will include grounds for solving gender problems. In conclusion, the following seven amendment were proposed: the definition of the sport underprivileged, the rights of the people, the responsibilities of the State and local governments, the basic principles of sport policy establishment and implementation, the establishment of a basic plan for sport promotion, the composition of the National Sport Policy Committee, and the investigation, research, and development for sport promotion.
