미국 캘리포니아주에서 주민투표를 통해 입법화된 농장동물학대금지법은 주민들의 식생활과 직접 관련되어 있는 달걀을 낳는 산란계, 암퇘지, 송아지 육류를 캘리포니아 주내에서 판매하기 위해서는 이 법에서 정한 이 동물들의 마리당 사육면적기준을 충족시켜야 한다는 강제규정이다. 최대한의 경제적 이윤을 위해 닭, 돼지, 송아지를 움직일 수 없게 된 우리에서 사육하는 잔인한 현실을 개선하고자 하는 캘리포니아 주민들의 의지가 반영된 법이다. 2018년 이 법의 통과 이후 소, 돼지, 닭 등의 사육업체들, 관련 요식업계들에 의한 격렬한 반대 소송들이 줄지어 제기되었지만, 2023년 5월 미국 연방대법원은 National Pork Producers Council v. Ross 판례에서 ‘캘리포니아주의 농장동물학대방지법이 위헌이 아니다’는 판단을 내리면서 모든 논란의 종지부를 찍었다. 메사츄세츠주도 유사한 입법을 통해 캘리포니아의 선례를 따르면서, 이제 더 많은 주에서 동물사육기준면적이 개선될 것으로 보인다. 한국에서도 돼지의 스톨(stall) 사육과 산란계들의 배터리 케이지(battery cage) 사육이 논란이 되는 현실에서 미국 캘리포니아주 농장동물학대금지법에서 개선한 닭, 돼지 송아지의 사육면적 기준 개선은 의미있는 시사점을 제시하고 있다.
Abstract
Californian Act for the Prevention of Cruelty to Farm Animal of 2018 was enacted by Prop 12, which was an agenda proposed by public proposition. The law regulates that egg-laying hens, mother pigs, and calf raised for veal should be raised in cages of certain sizes per animal, like cage-free housing systems, cages able to fully extend the animal’s limbs, and cages turning around freely, if those food products would be sold within California. This is a law reflecting the strong intention of Californian people who want to improve farm animal raising systems that do not allow any cage room for animals to lie down or move around for maximum profit. After the passing of this law in 2018, there had been many lawsuits by Californian restaurant owners, national and regional associations of pork producers and so on. But the US Supreme Court ended all those controversies by the case of National Pork Producers Council v. Ross in 2023, holding that the Californian Act for the Prevention of Cruelty to Farm Animal of 2018 is not violating the US Constitution because the law has some extraterritorial effect to other states’ businesses, but has no discrimination effect thereto. Massachusetts State also enacted a similar law, has been waiting for the US Supreme Court’s decision for the Ross, and so now moves forward for enforcement. The European Union has prohibited the battery cage system for raising hens, and the stall system for raising pigs is controversial as cruel and exploitive in Korea, too. Now, it is time to consider improvement of farm animal raising systems in view of the Californian Act.
