A Study on the Captain's Authority over Act of Unlawful Interference In-flight

You can easily access media articles raising issues about in-flight sabotage, such as the discovery of live ammunition, which is a prohibited item on board, and the opening of emergency doors. According to various statistical data, it is analyzed that the frequency and degree of illegal immigrants are continuously increasing. The reason why the illegal interference with aircraft continues to increase without decreasing is because there is a lack of understanding or awareness of the concept of illegal interference with aircraft, which is regulated by the current law. Accordingly, the concept of illegal interference was examined through comparative analysis at home and abroad, and the legal authority of the captain was examined through related laws. In addition, in the event of an illegal act on board, the limitations of the captain's actual exercise of authority will be reviewed, and realistic improvement plans will be suggested, such as granting the captain the authority of a judicial police officer, strengthening the supervisory authority of in-flight security personnel, and judicial immunity for follow-up measures.
