프랑스 국사원 연구부와 연간연구에 관한 소고- 행정법 연구방법론의 관점에서 -
A Study on “Section du rapport et des études” and “ETUDE ANNUELLE” in Conseil d'État- Focusing on the Methodology of Administrative Law -

프랑스에서 최고 행정법원인 동시에 입법, 행정에 관한 최고자문기관이기도 한 국사원(Conseil d'État)은 행정법 연구자들이 매료될만한 다양한 요소들을 갖고 있는데, 연구조직인 연구부(section du rapport et des études)도 그러하다. 국사원 개혁방안이 담겼던 이른바 Noël 보고서의 내용이 반영되어 1963년 첫 발걸음을 내딛은 연구위원회는 1983년 국사원 공식 조직(연구부)으로 자리잡았으며, 현재는 ① 공익에 기여할 수 있는 입법, 행정개혁 등에 관한 일반연구(ETUDE 및 GUIDE) 및 연간연구(ETUDE ANNUELLE) 업무, ② 연례보고서 발간 업무, ③ 국사원 판결의 집행력을 확보하는 업무, ④ 국제 관계에 관한 업무를 각 수행하고 있는데, 그 핵심인 연구업무의 내용을 살피지 않을 수 없다. 유사한 연구조직을 가진 프랑스 파기법원(Cour de Cassation), 감사원(Cour des comptes)의 연구물과 구별되는 국사원 연구부 연구물들에 고유한 성격은 국사원의 기능적 특성, 즉 최고행정법원인 동시에 입법/행정의 최고자문기관인 데에 상당부분 기인하고 있으며, 큰 이론체계를 형성해 가려는 연구보다는 실용적, 실무적, 주제별 연구의 성격이 분명하다는 점에서 프랑스 행정법학계의 행정법연구와도 구별되고, 多 학제적 연구(특히 행정학, 정책학, 통계학 등과)의 성격도 비교적 뚜렷하다. 그러나 ① 큰 틀에서 “법”실무연구로서의 밑바탕이 분명하고, ② 소송부(La section du contentieux), 자문부(Les sections consultatives)와 지속적인 상호작용을 이뤄가고 있으며 ③ 학계와 교류를 거치는 중에 평가되는 학술적 가치도 적잖다는 점에서 행정법연구자들이 주목해 볼 가치도 상당하다. 국사원 연구부의 여러 연구물들 중 먼저 지난 10년 간의 “연간연구”에 주목해보면, 연구부가 계속해서 프랑스에서의 과잉입법문제 및 법의 품질저하문제와 그 해결책에 집중해왔다는 점이 뚜렷하게 드러나는데, 2013년 수행된 연간연구인 “연성규범(Le droit souple)” 연구 및 2016년 수행된 연간연구인 “법의 간소화와 품질(Simplification et qualité du droit)” 연구를 중심에 두고 유사한 목적성을 가진 2015년 연간연구, 2018년 일반연구 및 2020년 연간연구를 순차적으로 살펴보면, 앞서 언급했던 국사원 연구부 연구물들의 성격이 더 구체적으로 확인된다. 특히 ① 정책의 합목적성, 효과성, 효율성, 적실성 등을 추구하기 위한 행정학, 정책학 및 통계학적 연구방법론에 기인한 내용(제언)들과 ② 합헌성, 합법성을 추구하기 위한 기존 법학방법론과 유사한 연구내용(제언)들이 맞물리면서 ③ 법정책학과 입법학적 성격의 연구가 무엇인지, 그리고 프랑스가 직면한 현실사회문제 해결에 천착하는 실용연구의 실제가 무엇인지 보다 구체적으로 살펴볼 수 있다. 행정규범을 “행정활동의 한계를 설정하는 것”이 아닌 “정책의 품질보증수단”으로 새로 인식하면서 입법학과 규제학, 행정조직법학 및 특별행정법학으로 연구의 지평을 넓히고 주요 연구방법론으로 학제 간 연구방법론에 주목하는 독일 신사조행정법학계의 행정법연구 내용에 비추어 프랑스 국사원 연구물들에 주목해 볼 필요가 적잖은데, 특히 최고행정법원인 소송부, 입법/행정의 최고자문기관인 자문부와 지속적인 환류(Feedback)를 이뤄가면서 그 연구가 이루어지고 연구결과가 각 부에 반영되게 되므로, 학제 간 연구를 이뤄가면서도 행정 “법학” 연구로서의 정체성을 지킬 수 있는 이른바 “연결개념”의 발견과 발전에 이바지할 수 있는 여지가 적잖다는 점에서 위 연구물들의 의의를 깊이 새겨볼 필요가 있다.
Abstract
In France, “section du rapport et des études” is a body of Conseil d'État. Founded in 1963 as the Commission du Rapport with the task of reporting to the government on the activity of the Conseil d’Etat and current problems that they identified, this body became the Section du Rapports et des Etudes in 1985. The first of those missions is to be the vehicle through which the Conseil d’Etat draws the attention of public authorities to the legislative or administrative reforms which it considers necessary in the public interest and develops a study(ETUDE, GUIDE) on these. In this role, “section du rapport et des études” goes beyond being a law reform commission. Some of these studies are developed into a full study as part of its annual report[ETUDE ANNUELLE- for example, Soft-law(2013), the simplification and the quality of legislation(2016), etc]. These studies will be worked on by members of the section together with others in the Conseil, and they will solicit such outside expertise as they find useful. To reform and expand methodology of Administrative law study, these studies can be useful. First, these studies are more concrete than those of “New Administrative law study” in German. Second, subjects of these studies are primarily concerned with real problems of France administration, legislation, and judiciary. Third, these studies are mainly performed by various methodologies of social sciences(science of public administration, policy sciences, economics, statistics, etc.) and complemented by legal Methodology. Fourth, these studies are worked on by members of the section together with others in the Conseil, facilitating feedback from others in the Conseil. The usefulness notwithstanding, it is necessary to maintain the identity of “law study”. Considering major challenges of interdisciplinary study methodology that scholars of “New administrative law study” in German are investigating, it is necessary to investigate “connecting concept” between law study and other social science study when considering these studies.
