플랫폼 노동의 정의와 노동권･단결권･사회권 관련 법･제도 비교연구:한국과 유럽연합을 중심으로

Digital platform work in the 21st century has emerged as one of the major changes in the global labour market. In particular, labour rights and social rights issues and institutional reforms have received significant attention. Since the European Union's legislative directive serves as a basic reference for the overall position of the legal and institutional framework for platform labour while taking into account the social and economic context and labour market practices of each country, a comparative study of the EU's legislative directive and Korea's legal and institutional framework is significant in that it provides a holistic view and diagnosis of Korea's legal framework for the protection of platform labour. First, this study examines the definition of platform work proposed by the European Union and the scale and status of platform work in European countries, and uses similar criteria to estimate the scale and characteristics of platform labour in Korea. Then, it conducts a comparative study of Korean and EU labour laws, trade union laws, and social security laws, focusing on how legal and institutional protections for platform work operate and secure the rights of platform workers. The findings of this study on the definition of digital platform labour and the comparative legal system may have implications for improving the legal system to ensure the rights of not only platform workers but also all workers working in new forms of nonstandard work.
