창의적 설계과목에서 창출된 아이디어를 전자출원하는 방법

학교의 창의적 설계과목에서 아이디어의 창출은 꾸준히 이루어지고 있고 이들 아이디어의 일부는 특허출원으로 권리화할 필요성이 있으나 이러한 아이디어들이 특허출원으로 이어지는 비율은 낮다. 그 이유는 변리사에게 특허출원을 맡기기에는 적지 않은 비용이 들고, 변리사의 도움없이 개인이 출원하기에는 명세서 작성과 여러 단계의 전자출원 절차를 거쳐 특허청에 온라인으로 출원하는 것이 쉽지 않기 때문이다. 전자출원 절차는 명세서 작성 단계, 전자출원 준비단계 및 전자출원 단계 등 세단계로 크게 나눌 수 있다. 전자출원 준비단계는 특허로사이트(www.patent.go.kr)에서 특허고객번호 신청, 인증서 등록 및 전자출원소프트웨어 다운로드 등 전자출원을 위한 준비를 하는 단계를 말한다. 전자출원 단계는 명세서작성기라는 소프트웨어에서 명세서 및 요약서를 작성하고 서식작성기 소프트웨어로 출원서를 작성하여 특허청에 온라인으로 출원하는 절차이다. 본 논문에서는 대학교에서 명세서와 전자출원 절차를 지도해 왔던 경험을 바탕으로 대학생 및 일반인들이 비교적 쉽게 전자출원을 할 수 있는 방법에 관하여 기술하고자 한다.
Abstract
Although creation of invention is made steadily at the university creative design courses, not many inventions are applied for patent. It is because leaving patent application to the patent attorney is costly and filing patent application personally is a troublesome task to go through writing specification and strict electronic filing procedure. Online patent application process is divided into three steps: writing patent specification, the preparatory process and the electronic filing process. The preparatory process includes request for patent client number, registration of certificate of authentication and download of online filing software. And the electronic filing process is an actual filing procedure using softwares like electronic specification generator and application generator. In this these, a simple way of electronic patent filing method after creation of invention shall be described on the basis of teaching experiences at the university.
