유전자·줄기세포 특허의 윤리적 쟁점에 대한 고찰

인간 게놈 프로젝트(Human Genome Project) 이후 생물종에 대한 유전체 지도가 완성된 이래로 다국적 기업들은 유전자와 줄기세포를 이용한 발명을 특허로 보호받고자 집중적인 투자를 진행하고 있다. 또한 세계 각국은 유전체 및 줄기세포 특허의 우위를 차지하기 위한 노력을 가속화하고 있다. 한편, 유전자를 이용한 기술에 대해 독점배타적인 특허권을 인정하여서는 안 된다는 윤리적 차원의 문제가 제기되고 있다. 본고는 유전자 및 줄기세포 특허와 관련한 각국의 현 제도 및 현황을 살펴보고, 유전체·줄기세포 특허에 대한 윤리적 쟁점을 고찰하였다. 특허 제도의 목적은 발명을 보호하고 장려함으로써 국가산업의 발전을 도모하기 위한 것이므로 유전체·줄기세포를 이용한 발명에 대해 특허법상 발명의 성립성은 인정하는 것이 바람직하다. 아직 발생하지 않은 윤리적 문제의 가능성만으로 이를 불특허사유로 정해서는 안 되며, 공중의 위생을 해칠 우려가 없는 제한적인 범위 내에서 치명적인 질병의 치료를 목적을 가진 특허의 특허적격성을 인정하여야 한다. 그러나 유전체에는 권리주체의 유전정보 일체를 내포하고 있으므로 면밀한 보호가 요구되며, 유전정보 유출 사고가 발생하지 않도록 철저한 보안이 필요하다. 아울러 유전체 및 줄기세포 관련 기술 발명을 원천기술 특허로 획득하기 위해서 국가적 차원에서 유관 기관 간의 주기적인 협업을 통해 유전체와 줄기세포 기술 특허를 확보할 수 있도록 제도적인 뒷받침이 요구된다. 지식재산 지원 정책들을 통해 수준 높은 원천기술 특허를 확보하고, 글로벌 바이오산업을 우리나라의 핵심 성장산업으로 견인하여야 할 것이다.
Abstract
The bio industry has become a key growth industry driving the global economy, and patent competition is accelerating as countries around the world proceed with the development of genetic and stem cell research. Ethical questions are raised about recognizing exclusive patent rights for these gene and stem cell technologies. This study looked at the system and current status regarding genetic and stem cell patents, and addressed ethical issues regarding genetic and stem cell patents. Because the purpose of the patent system is to promote the development of the national industry by protecting and encouraging inventions, it is desirable to recognize the validity of inventions under the Patent Law for inventions using Genetics and Stem Cells. In addition, the possibility of ethical problems not yet occurring should not be treated as a non-patent cause, and patent eligibility should be recognized for the purpose of treating fatal diseases within a limited range that is not feared to harm public hygiene. Genes contain extraneous and essential information that contains all genetic information of the right subjects, which requires thorough protection and thorough security to prevent leakage. These related discussions will have to continue in the future. Also, at the national level, the government should make efforts to secure patents for genetic and stem cell technology through periodic collaboration among related agencies. Through policies to support intellectual property, it will be necessary to secure patents for original technology by creating high-quality IPs and increasing the added value of research, and to drive the global bio industry as the core growth industry of Korea.
