대학교에서의 특허교육을 위한 명세서의 구성 및 작성사례 연구

대학교에서의 지식재산권 교육을 크게 이론 강좌과 실무강좌로 나눌 수 있다. 이론 강좌에서는 대략 지식재산개론이라는 강의명으로서 특허를 중심으로 지식 재산권 전반에 대한 이론적인 교육이 이루어지고, 학생들은 지식재산능력 검정시험(IPAT; Intellectual Property Ability Test)을 응시하게 된다. 실무 강좌에서는 통상 아이디어(발명)의 창출로 시작하여 특허정보 검색과 특허출원에 관한 교육을 하게 된다. 특허출원을 위해 필요한 서류는 출원서, 명세서, 도면(필요한 경우) 및 요약서가 있으나, 특허출원 서류의 핵심은 명세서라고 할 수 있다. 대학교의 공학설계와 관련된 강좌에서 아이디어 창출은 꾸준이 이루어지고 있고 이 아이디어들 중 적어도 일부는 특허출원으로 권리화할 필요성이 있다. 그러나, 한정된 수업 일정 중에 학생들이 명세서를 제대로 작성하여 특허 출원을 하기는 쉽지 않다. 본 논문에서는 대학생들에게 특허청구범위를 중심으로 명세서를 작성하는 방법을 지도해 왔던 경험을 바탕으로 하여 대학교에서의 특허교육을 위한 명세서의 구성과 작성사례에 관하여 기술하고자 한다.
Abstract
IP education in the university can be devided into theoretical classes and practical classes. In theoretical classes, in the name of ‘Introduction to Intellectual Property', the teachers educate the whole area of intellectual property focusing on patent, and students take IPAT(Intellectual Property Ability Test). In practical classes, students normally learn creation of invention, patent information search and patent applicaion process. Among documents for patent application, specification is most important. Creation of invention is made steadily at the engineering design classes and at least some of the inventions need to be applied for patent. However, in the limited class schedule, writing specification and applying patent application by students are quite difficult. In this thesis, the structure and samples of patent specification for patent education of the university shall be described on the bases of teaching experience.
