AI 규제를 위한 국제협력 방안 ― 국제기구의 역할과 기능에 관한 국제법적 검토를 중심으로 ―

There is a growing consensus on the need of establishing an international organization to respond to the risks posed by artificial intelligence (AI). On 21 June 2023, President Yoon Seok Yeol declared the ‘Paris Initiative’ at the ‘Paris Digital Vision Forum’ held at Sorbonne University in Paris, which embodies the establishment of a new digital order, emphasizing the importance of a regulatory system and specifically proposing the establishment of an international organization. This study aims to examine the establishment of an international organization as a method of international cooperation for AI regulation from an international law perspective. Specifically, it examines the role and function of international organization in relation to AI regulation. Specifically, the international organization can be considered to have three main functions: providing a forum for negotiations, establishing and enforcing relevant norms, and resolving disputes. The role and function of the organization will be examined in relation to these functions. First, an international organization for AI can be considered as a venue for discussing and consulting on issues related to the use and regulation of AI, such as securing credibility among countries, mutual recognition of regulation, cooperation with relevant organizations, and capacity building and exchange. Second, it is necessary to establish an international organization for AI to establish and enforce relevant norms. Third, if a member state fails to fulfill its obligations, disputes may arise between member states. Therefore, it is necessary to establish and operate a dispute settlement system. As AI-related disputes are likely to involve scientific and technical issues, it is necessary for the system to consider the opinions of ‘technical experts’ or establish a consultation system with relevant international organizations as deemed appropriate.
