인공지능(AI)의 법적 쟁점에 관한 고찰

초록
최근 우수한 성능의 인공지능이 보급되어 이용되고 있다. 인공지능이란 일반적으로 인간의 지능과 유사한 고도의 문제해결 능력을 가진 인공적 지능을 말하는데, 인공지능의 수준이 대단히 높아져 사람들을 놀라게 하고 있다. 인공지능을 법적 측면에서 보면, 인공지능의 판단과 행동에 어떠한 법적 책임을 물을 수 있는가가 주요 이슈인데, 인공지능의 판단으로 인하여 손해가 발생했을 경우 그 배상책임에 관하여, 인공지능 설계자, 운용자, 탑재회사 등 관계자 중 누구에게 책임이 있는지 정리될 필요가 있다. 이러한 문제는 단지 입법론의 문제에 그치는 것이 아니고, 본격적 인공지능시대를 맞아 그에 관한 국민적 합의와 경제적·사회적 파급효과 등 여러 논점에서 관련 법제도가 전반적으로 정비되어야 한다. 오늘날 인공지능 시대를 사는 우리는 이러한 법적 책임을 둘러싼 당사자간 이해관계의 합리적 조정과 안전한 삶을 위한 사회제도 마련을 위한 지혜가 필요하다. 이른바 특이점을 지나 인간수준의 자유의지를 가진 인공지능 즉, 인간처럼 생각하고 행동할 수 있는 인공지능로봇이 출현할 경우 로봇은 인간유사한 활동을 보이게 되어, 인간과 인공지능 로봇이 더불어 함께 살아가는 시대가 도래할 것이다. 하지만 이러한 상황은 아직은 미래의 이야기이며, 인공지능에 인간과 비슷한 수준의 자유의지를 부여할 것인지는 현재의 인류에게 부과된 최대과제라고 할 수 있다. 현재 인공지능의 기본법리를 검토한 선행연구는 상당수 있으므로 본문에서는 인공지능의 분야별 입법쟁점에 관하여 공법, 사법, 사회법 등 분야로 나누어 구체적으로 입법적 쟁점을 검토해 보았으며, 그 내용을 크게 정리하면 다음과 같다. 첫째, 안전과 윤리에 관한 입법이 필요하다. 인공지능기술은 매우 강력하며, 이에 따라 실수, 오작동 또는 악용이 인간의 생명과 안전, 권리와 자유를 침해할 가능성이 있으므로 이에 대한 대처와 법적 규제가 절실하고 당위성도 인정된다. 둘째, 개인정보보호 규정의 입법이 필요하다. 인공지능이 개인정보를 수집하고 분석할 수 있는 능력을 가지고 있으므로 이에 대한 보호와 규제가 반드시 필요하다. 개인정보보호를 위한 법률들은 이미 많이 존재하지만, 인공지능이 수집하는 데이터와 분석 방법들에 대해서 더욱 구체적인 법적 규제의 추가가 필요하다. 셋째, 책임에 관한 입법이 필요하다. 인공지능은 프로그램에 의해 작동하므로 개발자와 운영자는 책임지고 관리해야 한다. 이러한 책임에 대한 법적 규제와 책임 분담 방법에 대한 고민이 필요한 것이다. 넷째, 경제적 기술적 발전에 따른 신규입법이 필요하다. 인공지능기술이 발전함에 따라 기업들의 경쟁력과 성장이 크게 영향을 받으므로 기업들은 이러한 기술을 이용하고 발전시키기 위한 투자와 개발, 규제에 대한 협력과 지원이 필요하다. 이에 따라 인공지능이 사용되는 분야에서는 그 법리적 쟁점을 해결한 입법이 필수적이며, 이를 통해 인공지능의 이점을 최대한 살리면서 안전하고 효과적인 이용을 보장하게 될 것이다. 본문에서 검토된 내용을 반영하여 다수의 법률영역에 효과적인 입법이 행해짐으로써 인공지능에 관한 안정적 법적용이 가능해지기를 기대한다.
Abstract
Recently, artificial intelligence with excellent performance has been spread and used. Looking at artificial intelligence from a legal aspect, the main issue is what kind of legal responsibility can be held for the judgments and actions of artificial intelligence. Living in the age of artificial intelligence today, we need wisdom to rationally coordinate the interests of the parties surrounding these legal responsibilities and prepare social systems for a safe life. If artificial intelligence with human-level free will, that is, an artificial intelligence robot that can think and act like a human, emerges after passing through the so-called singularity, the robot will show activities similar to humans, and the era in which humans and artificial intelligence robots live together is coming. However, this situation is still a story of the future, and it can be said that whether to grant artificial intelligence a level of free will similar to that of humans is the greatest task imposed on mankind today. The summary of the legislative issues in each field of artificial intelligence is roughly as follows. First, legislation on safety and ethics is needed. Artificial intelligence technology is very powerful, and accordingly, mistakes, malfunctions, or abuses may infringe on human life and safety, rights and freedoms, so countermeasures and legal regulations are urgently needed and appropriate. Second, it is necessary to legislate personal information protection regulations. Since artificial intelligence has the ability to collect and analyze personal information, protection and regulation are essential. Although there are already many laws for the protection of personal information, more specific legal regulations are needed for the data collected and analyzed by artificial intelligence. Third, legislation on accountability is needed. Since artificial intelligence works by programs, developers and operators must manage it responsibly. It is necessary to think about the legal regulation of these responsibilities and how to share them. Fourth, new legislation is needed according to economic and technological development. As AI technology develops, the competitiveness and growth of companies are greatly affected, so companies need cooperation and support for investment, development, and regulation to use and develop these technologies. Accordingly, in the field where artificial intelligence is used, a legal system that resolves issues related to artificial intelligence is essential, and through this, it will ensure safe and effective use while maximizing the benefits of artificial intelligence.
