선거보도 심의제도 개선방안에 관한 소고(小考) ― 기구 통합 문제 및 심의기준 통합 가능성을 중심으로 ―

미디어 융합 현상은 선거보도 심의뿐만 아니라 미디어 내용 심의 전반에 걸쳐 복잡한 과제를 안겨주었는데, 앞으로도 그 융합은 가속화 될 것이고 그 사회적 영향력은 확대될 것이라는 점에서 진행형이라고 할 수 있다. 그러한 점에서 선거보도 심의기구 통합에 대한 논의는 자연스러운 현상이라고 볼 수 있다. 그런데 선거보도 심의기구 통합은 심의기구별 상위기관의 이해관계 때문에 현실적으로 어렵다고 판단되고, 무엇보다 끊임없이 변화하는 융합매체 환경에서 선거보도의 공정성 확보는 국가의 규제로는 한계가 있다는 점에서 결국 자율규제로 전환해야 하는데 현재 시점에서 기구의 통합은 국가의 규제를 오히려 공고히 하는 것으로서 적절치 않다는 판단된다. 따라서 현재는 과도기적으로 현행 매체별 선거보도 심의기구를 유지하고 문제가 있을 시 개선을 해 나가면서 자율규제로의 전환을 준비하는 것이 타당하다는 판단에서 선거보도 심의기준의 통합 가능성에 대해 시론적(試論的)으로 검토를 하였다. 우선 ➀ 통합심의 기준이라고 할지라도 매체의 특성을 반영하여 차등하여 심의기준 정립이 가능하고, ➁ 매체가 다를지라도 공정한 선거보도의 목적은 동일하고 그 수단으로서 심의제도를 채택한 점, ➂ 「공직선거법」 제8조에서 동일한 의무를 부담하고, 같은 법률에 의해 심의기구가 설립된 점, ➃ 매체별 경계가 불명확하고, 영향력 측면에서 인터넷언론의 영향력이 점점 확대해지고 있다는 점, ➄ 현재의 매체별 선거보도 심의기준은 보도의 공정성･형평성, 객관성, 정치적 중립성 등의 표제 아래 내용적으로 같은 기준으로 언론보도의 공정성을 심의하고 있다는 점에서 심의기준 통합 가능성이 있다고 판단된다.
Abstract
The phenomenon of media convergence has presented complex challenges not only in the deliberation of election reporting but also in the overall deliberation of media content and it is expected that the convergence may accelerate in the future, thereby being an ongoing process in that its social influence would expand. In that respect, discussion on the integration of the deliberation system for election reporting is considered a spontaneous phenomenon. However, there are practical limitations in integrating the deliberation system for election reporting due to the different interests of higher-level systems for each deliberation system and above all, considering the limitations of national regulation alone in securing fairness in election reporting in the ever-changing convergence media environment, there is a need to ultimately switch to autonomous regulation, although at the present time, integration of systems is not considered appropriate in that it would actually solidify national regulations. Therefore, under the judgment that it is currently appropriate to prepare for the transition to self-regulation by maintaining the deliberation system for election reporting by each current media in a transitional manner and improving the newly created problems, a theoretical review on the possibility of integrating deliberation criterias for election reporting is conducted. As a result, it is found that there is a possibility of integrating deliberation criteria according to the following. : ➀ Even in the integrated deliberation criteria, it is possible to establish deliberation criteria with differential reflection of the characteristics of each media. ➁ Different media have the same purpose of fair election reporting, and the deliberation system was adopted as a means of achieving it. ➂ The same obligations are assumed under Article 8 of the 「Public Official Election Act」 and the deliberation system was established by the same law. ➃ The boundaries of each media are unclear, and the influence of Internet media is gradually expanding in terms of influence. ➄ The current deliberation criteria for election reporting by each media are deliberating the fairness of media reporting based on the same standards in terms of content, under the headings of fairness, equity, objectivity, and political neutrality.
