학교안전법상 교육활동과 학교안전사고 관련 쟁점 연구

학교안전사고로 인하여 교육과 학업에 전념할 수 없는 환경을 예방하고자 하는 목적에서 서울에 학교안전공제회가 설립되었고, 그 후 다수의 공제회가 설립되었다. 하지만 보상재원 마련을 위한 기금조성의 어려움과 각각의 지역마다 보상기준과 한도의 불균형이 발생하였다. 이러한 부분을 해 소하기 위한 목적으로 학교안전법이 제정되었다. 학교안전법의 제정은 학교안전사고를 예방하는 효 과를 야기하고 피해자 보상이 신속하게 이루어질 것이며, 보상 역시 적절하게 이행하는 효과가 발 생하게 되었다. 본 논문은 학교안전법에서 규정하고 있는 ‘교육활동’ 관련 법적 쟁점과 ‘학교안전사고’ 관련 법적 쟁점을 다루고 있다. 학교 교육현장에서는 예기치 않은 안전사고가 빈번하게 발생하고 있으나, 피 해에 대한 책임의 주체와 범위 등에 대하여는 명확하지 않은 것이 대부분이다. 학교안전사고가 발 생하면 학교안전사고의 책임유무에 대한 판단은 예측가능성이 중시되므로, 사고 유형별로 교원 등 의 과실을 인정하기 위한 합리적 기준을 설정해야 할 필요성이 있다. 이는 교육활동의 안정성에 기 여하는 효과를 가져다 줄 것이다. 학교안전사고와 관련된 다양한 지역과 활동 중에 발생하는 사고 및 여러 방식의 질병 등을 학교 활동참여자들은 명확히 이해하고 습득하여 법적 분쟁으로부터 자유로운 학교생활이 영위되어야 할 것이다.
Abstract
The School Safety Mutual Aid Association was established in Seoul with the aim of preventing an environment in which education and study cannot be concentrated due to school safety accidents, and a number of mutual aid associations were established thereafter. However, it was difficult to raise funds for compensation resources, and there was an imbalance between compensation standards and limits in each region. The School Safety Act was enacted with the aim of addressing these areas. The enactment of the School Safety Act had the effect of preventing school safety accidents, compensation for victims would be made quickly, and compensation would be properly implemented. This paper deals with legal issues related to ‘educational activities’ and ‘school safety accidents’ stipulated in the School Safety Act. Unexpected safety accidents frequently occur in the school education field, but in most cases, the subject and scope of responsibility for the damage are not clear. When a school safety accident occurs, predictability is important in determining whether or not to be responsible for the school safety accident, so it is necessary to establish reasonable standards for acknowledging the negligence of teachers for each type of accident. This will have the effect of contributing to the stability of educational activities. Participants in school activities should clearly understand and acquire accidents and various types of diseases during various regions and activities related to school safety accidents to lead a school life free from legal disputes.
