중국의 인공지능 관련 법제 연구 – 생성형 인공지능 서비스 관리 임시방법을 중심으로 –

With the goal of becoming a global AI powerhouse, China has implemented a series of policies to support the development of AI technology and industry, and has also issued a code of ethics to promote responsible AI research and development. At the end of 2022, ChatGPT was released, and just four months later, China unveiled the ‘Measures on the Administration of Generative Artificial Intelligence Services(Draft)’. This draft was published in a short period of time, so numerous experts expressed critical opinions during the comment period. Responding to these criticisms, the ‘Interim Measures for the Administration of Generative AI Services’ was released in July 2023. While enacting the Interim Measures so soon may have been in response to the timely regulation of the problems that have emerged in generative AI, such as fake news and copyright infringement, it is not enough to justify the urgency. In this article, I examine the key contents of the ‘Interim Measures for the Administration of Generative AI Services’, compare them with the draft, and analyze the true intentions behind these Interim Measures. Additionally, I explore the implications of China's data legislation in the competition for AI supremacy between the United States and China. In South Korea, several legislative proposals, including the ‘Act on Fostering the Artificial Intelligence Industry and Creating a Foundation for Trust’ have been proposed, and I draw out the implications of China's AI legislation.
